To sue ASDA?!

Ok so maybe not actually sue- but to be very annoyed and shaken up?

This afternoon I was shopping in a (reasonably small) ASDA supermarket picking up items for my gran.

I turned an empty aisle and noticed a ‘cleaning in progress’ sign on one side. No visible spillage and the sign was only on one side so I walked around it (gave a wide berth), Boom, I was on the floor having landed heavily on my right knee.

My fiancé, who was with me, picked me back up and another middle aged chap came running up to help. He had just fallen himself, in the exact same spot as me! The floor was coated in a slippery oil based substance - it had stained his jeans.

A minute later an employee came running up apologising profusely - the chap told her off as she had ‘wiped’ the floor after he fell but obviously done a terrible job. As I hobbled away I saw her retrieve a bucket and mop.

I went to the customer service desk and manager was called- he was nice and apologised (gave me a nominal gift card) but I wasn’t in pain, just shaken and annoyed as had that been my very elderly grandmother or heavily pregnant cousin (who it would have been had I not volunteered) it would have been very dangerous!

Since I got home my knee has seized and is now bruised and swollen in a lump. I’m 25- fit and healthy - never had anything like this happen before. But I’m really annoyed that It did- I won’t be able to cycle to my office tomorrow 😒 and expect I’ll be sore for a while. I’ve never considered suing anyone for anything but think this could easily have been avoided!

To sue ASDA?!

She'd left to get a mop? What a bitch eh? Maybe she should have tried "accio mop" instead.

KnightlyMyMan · 18/11/2018 19:58

@soarkling she mumbled ‘I know I was just going to get....’

DwangelaForever · 18/11/2018 19:58

It’s annoying and it doesn’t feel very fair.

Life's not fair. Get over it.

Part of a Ben and Jerry's display at the odeon fell on me and broke my big toe and I didn't sue them - much more dangerous than you slipping on a floor that had a wet floor sign there 🙄.

Claim culture has ruined the world.

Anasnake · 18/11/2018 19:58

So the cleaning was in progress just like the sign said ??

Sparklingbrook · 18/11/2018 19:59

That poor employee. Sad

Grilledaubergines · 18/11/2018 20:00

In all likelihood, the opposition will state contributory negligence. Which they’d be right about.

Honestly, people out for an easy buck. It’s so embarrassing.

Iseesheep · 18/11/2018 20:00

You just don't want to know if you're being unreasonable or not. Just go ahead and sue. It's what you're going to do anyway!

Poisongirl81 · 18/11/2018 20:01

I actually agree with op... What if it had been a pregnant lady who miscarried what would you all say then? In my asda if its bad someone stands near the sign telling people to turn round.

MarthaArthur · 18/11/2018 20:01

Dwangela i hope you got a free ice cream at least Grin

WhirlyGigWhirlyGig · 18/11/2018 20:02

Op an eye roll emoji because you think you're right and annoyed doesn't make it right. Be all sorry for yourself, fine but it'd be better to chalk it up to experience and move on 🙄

Sparklingbrook · 18/11/2018 20:02

All the 'what ifs' are irrelevant.

If the employee stands near the sign who is getting the cleaning equipment?

Breakyourselfagainstmystones · 18/11/2018 20:02

Poisongirl81 but it wasn't. You could sit and 'what if' all day long. It doesn't change the fact that it was the op and she just bruised her knee.

WinterSpiceOnIce · 18/11/2018 20:03

No...

You don't know she 'half cleaned it' and you don't know where she originally put the sign

You are guessing

PerverseConverse · 18/11/2018 20:03

YABU. Put an ice pack on it and take some ibuprofen. I used to assess claims things like this and I wouldn’t have deemed yours worthy of any investigation. There was a sign, you saw it, ignored it and walked over the area. Next time you visit see if they’ll sell you a grip.

sparklefarts · 18/11/2018 20:03

Oh for the love of love.

Yes you had an accident.
Yes I am sure it is annoying and inconvenient etc.

But have you be 'wronged' so bad that you should sue? Hell fuck no. Hmm

TacoLover · 18/11/2018 20:04

If it's cleaning in progress than the cleaning is still going on isn't itConfused so obviously there's a risk.

WinterSpiceOnIce · 18/11/2018 20:05

And here we have the start of drip feeding 💧💧💧💧

  • @soarkling she mumbled ‘I know I was just going to get....’*
Nightgremlin · 18/11/2018 20:05

Most of the cleaning in progress signs are double sided A shaped -
Cleaning in progress one side and wet floor the other.
And what were you expecting from the employee? Go go gadget arms to locate a mop while she stayed guarding the spill she's already put a sign out to warn people of?
And why didn't the guy warn you if he'd already fallen? That would have been a decent thing to do instead of watching you fall and then shouting at a member of staff.
He's out of order for not warning you and so are you for ignoring the sign and then blaming someone else for your mistake.

IHopeThisIsAGoodIdea · 18/11/2018 20:05

OP: AIBU?
99% of Posters: YABU!
OP: No, I'm not!!!

🙄🙄🙄🙄🙄🙄

KnightlyMyMan · 18/11/2018 20:06

Wow people are so nasty 🤔 I won’t sue, don’t have time if I wanted to just annoyed and know it wasn’t my fault.

I hope you all run the opposite way at the sight of a ‘cleaning in process’ sign though as apparently you could get slapped in the face with a tsunami and it’d be your own fault as you’d been ‘adequately warned’! 😂

2 customers down in the space of 5 mins and the supermarket isn’t at fault? 😂 ...ok

I’m the least ‘claims culture’ person in the world so your insults/ petty nasty comments are totally uncalled for and a bit pointless.

OP posts:
anniehm · 18/11/2018 20:07

It's happened to me - no sign in this case, customer had knocked a bottle of oil onto the floor and it had split, customer then put it back on the shelf leaking, cctv showed everything. They were apologetic, took my details, offered a £10 gift card plus to reimburse dry cleaning of my coat if I brought the receipt in - they emailed me with the full details from the cctv a couple of days later very apologetically. Yes it was a bit painful but they were not negligent, some things are just unfortunate.

MissionItsPossible · 18/11/2018 20:07

Tbh it sounds like you and the 'chap' cooked this up between you to get some money out of it. It's a bruise. It didn't leave you without a leg.

Sistersister7 · 18/11/2018 20:07

You're the least 'claims culture person in the world" yet asking if you should sue? Get a grip

Sparklingbrook · 18/11/2018 20:08

From now on if I see one of those yellow signs I will leave my shopping and get out of the shop asap just to be sure.

I be t the employee was mumbling while holding back tears as running middle aged chap was having a go at her.

sparklefarts · 18/11/2018 20:08

I’m the least ‘claims culture’ person in the world

No you ain't love.
