To sue ASDA?!

Ok so maybe not actually sue- but to be very annoyed and shaken up?

This afternoon I was shopping in a (reasonably small) ASDA supermarket picking up items for my gran.

I turned an empty aisle and noticed a ‘cleaning in progress’ sign on one side. No visible spillage and the sign was only on one side so I walked around it (gave a wide berth), Boom, I was on the floor having landed heavily on my right knee.

My fiancé, who was with me, picked me back up and another middle aged chap came running up to help. He had just fallen himself, in the exact same spot as me! The floor was coated in a slippery oil based substance - it had stained his jeans.

A minute later an employee came running up apologising profusely - the chap told her off as she had ‘wiped’ the floor after he fell but obviously done a terrible job. As I hobbled away I saw her retrieve a bucket and mop.

I went to the customer service desk and manager was called- he was nice and apologised (gave me a nominal gift card) but I wasn’t in pain, just shaken and annoyed as had that been my very elderly grandmother or heavily pregnant cousin (who it would have been had I not volunteered) it would have been very dangerous!

Since I got home my knee has seized and is now bruised and swollen in a lump. I’m 25- fit and healthy - never had anything like this happen before. But I’m really annoyed that It did- I won’t be able to cycle to my office tomorrow 😒 and expect I’ll be sore for a while. I’ve never considered suing anyone for anything but think this could easily have been avoided!

To sue ASDA?!

If your are planning on suing, I'd make a trip to a&e so that your infirmity is documented. I'd also not go to work tomorrow because your are not able to move due to significant pain.

Document everything so you can justify the amount you will be claiming for compensation.

Good luck on finding a law firm to represent you -perhaps a no-win no-fee one?

You are absolutely right to be livid. They should have closed the aisle for a clean up. I'd fight for a hefty gift card. Write to corporate and cc their legal department- that always gets results.

Well she couldn't very well conjure a mop could she, hence the warning sign put out n her absence. Poor her, being moaned at by people who blatantly waltzed through a slippery floor, is working a Sunday shift on minimum wage not shit enough she has to be bellowed at?

This isn’t ringing exactly true for me.

Mops and buckets are not part of the ASDA Aces (the cleaning team) kit. They do not ever use a bucket. Only ever a micro fibre mop with a small amount of cleaning solution. This is specifically so the floor is never wet enough to be a slip hazard.

I tripped on an uneven pavement slab when out running a few weeks ago and ended up with a very similar injury to my knee. It’s still a bit painful and the lump is still there. Do you think I should sue the council op? Serious question

You realise the employee is a human and not a robot who keeps a mop about her person?when the oil spilled and she saw this, what do you expect her to do if she has no cleaning products? An incantation? Summon her patronising for help?

People aren't being nasty they are very reasonably telling you you're not in a position to sue or anything else because you ignored a sign warning you not to be in that area

Maybe you should be suing the other customer. The one that knew the floor was slippery, knew the sign was in the wrong place and said nothing whilst you stepped onto the spill that caused him to fall?

Although you would have to demonstrate whatever you have lost out on financially that requires monetary compensation.

🤔 has no one ever had something really annoying/unreasonable happen and been pretty tempted to do something they would regularly consider?

Anyone jumping to conclusions because I was ‘tempted’ to kick up a fuss after getting hurt today trying to buy some butter is just over bearing! I started my OP with ‘ok maybe not sue but be upset/annoyed’ think that respresents my state of mine quite well.

I’ve had multiple Opportunities to claim and never considered it but today I was just stood listening to the managers apologies thinking ‘wow, leaving an oily slip and slide of an aisle unattended with only a small sign placed far away is a totally stupid thing to do’

A ‘cleaning in process’ sign is only appropriate if it’s still safe as long as you exercise caution - not if you’re basically certain to fall! I walked as far away from the signed area as I could, wearing solid footwear and walking slowly/normally.

Come to think of it I have never seen anyone mopping a spillage in a supermarket with a mop and bucket. Tends to be paper roll or that powder you chuck on that absorbs the liquid.

It must have taken her a while to locate the mop and bucket and fill the bucket with hot water and detergent ready to clean the invisible spillage.

Poor woman I wonder if she got any of her actual work done today?

@MarthaArthur I got my whole trip to the cinema for free we milked it and got a core sundae crisps sweets and juice too as well as the tickets 😂😂
