To sue ASDA?!

Ok so maybe not actually sue- but to be very annoyed and shaken up?

This afternoon I was shopping in a (reasonably small) ASDA supermarket picking up items for my gran.

I turned an empty aisle and noticed a ‘cleaning in progress’ sign on one side. No visible spillage and the sign was only on one side so I walked around it (gave a wide berth), Boom, I was on the floor having landed heavily on my right knee.

My fiancé, who was with me, picked me back up and another middle aged chap came running up to help. He had just fallen himself, in the exact same spot as me! The floor was coated in a slippery oil based substance - it had stained his jeans.

A minute later an employee came running up apologising profusely - the chap told her off as she had ‘wiped’ the floor after he fell but obviously done a terrible job. As I hobbled away I saw her retrieve a bucket and mop.

I went to the customer service desk and manager was called- he was nice and apologised (gave me a nominal gift card) but I wasn’t in pain, just shaken and annoyed as had that been my very elderly grandmother or heavily pregnant cousin (who it would have been had I not volunteered) it would have been very dangerous!

Since I got home my knee has seized and is now bruised and swollen in a lump. I’m 25- fit and healthy - never had anything like this happen before. But I’m really annoyed that It did- I won’t be able to cycle to my office tomorrow 😒 and expect I’ll be sore for a while. I’ve never considered suing anyone for anything but think this could easily have been avoided!

To sue ASDA?!

But the spillage wasn't visible to you, so how was the employee supposed to see it?

You feel wronged because you weren’t careful despite knowing the area was being cleaned? You’re trying to pass your fall onto someone else; you are your own responsibility, so own your mistakes.

That other customer had no right to have a go at the employee. She did nothing wrong.

But realistically it could have happened anywhere and you would've been in the same situation.

I've actually just twisted my ankle and I can't blame anyone but me. Though I should probably contact the council to fix the bloody pavement.

Its a little bruise how dramatic can you be. You and the other idiot man both decided to ignore the sign so you get what you deserved. We have this where i work. We put out wet floor signs and people will still try it on wanting compo or free gifts when they deliberately ignore the signs. Oh and us minimum zero hour contract workers get yelled at a lot.

I’m surprised how many people think that having a ‘cleaning in process’ sign at one side of an aisle is enough to stop anyone walking down the entire aisle. 🤔

But there's a good chance that another customer moved the sign rather than the staff.

I get it, you're grumpy and in pain so you're annoyed, but we're talking apology territory, not suing territory here.

It wasn’t even a big sign - just a little foldy one and was a good 4-5 meters away from where I actually fell.

The sign was placed specifically to let shoppers know there had been a spill which was being cleaned up.

You chose to ignore the sign. What exactly do you want from Asda?

You slipped and bruised your knee on a spillage which was being cleaned up - what exactly would you sue for? It was an accident - who would you sue if you slipped at home on something a child had spilt?

If there’s a spill then place a sign over the spill - not at the other end of the aisle- two shoppers fell in 5 minutes of each other. Both adults - both wearing appropriate footwear and shopping normally - Sticking a small sign 4-5 meters away isn’t really appropriate warning.

So it really is all about sign placement. The 'middle aged chap' came 'running' to help you so I am guessing he was fine.

That does look sore, it hurts to fall on your knees. I hope it heals quickly.

But YABU. I hate this 'sue' culture.
There was a sign up. They were obviously dealing with it. You fell, ACCIDENTALLY. They made sure you were ok and gave you a gesture.

Leave it alone.

There’s no point wondering what if it was someone else because it wasn’t! You can’t sue on the basis of “well yes I just have a bruised knee but if it had been my elderly grandmother she might have been seriously hurt”

I feel very sorry for the employee who got shouted at by a rude member of the public and probably by the manager as well.

Accidents happen, that’s life. They had a sign up, you walked around it.

No the signs are usually meant to go ahead of the spill to signify a wider area to avoid in case it leaks. You sound like a drama queen. You dont want money even though you got a gift card so what do you want? You seemed happy enough for a worker to be told off so what is it you wanted? Her to be fired? Its a tiny bruise and its entirely your fault.

The sign said Cleaning In Progress, not Cleaning Has Finished. Regardless of what the employee was seen doing. I'm sorry your knee hurts but I'd put it down to an annoying accident.

Surely common sense would dictate that a sign in an aisle would mean you take care in general down that aisle?
I ended up covered head to toe in a cleaning product a while ago in a supermarket, I didn't decide to 'sue' them.

An accident. Making it out to be anything other than that is wrong. The blame and compensation culture is malignant in our society.
