In response to the Karen White case, there is a petition to ask the government to review their rules on putting males in women's prisons.

If the person without a penis is a woman, in a women’s prison.

If the person without a penis is a man, biologically, then I would look next at whether they had a GRC.

If they did, then I don’t know, and this is what the petition is about! The rules at the moment don’t work.

It's not completely clear whether the prison service can exclude a transvestite (male) woman from women's prisons if they have a GRC because they must legally be treated as a woman in every way.

The relevant Act specifies that single-sex exemptions can still be made if it is justifiable to do so.

(Sorry, cannot find my link to the exact wording.)

Unfortunately, most organisations are not implementing this exception because - IMO - they are too 'woke' for sense, or because they cannot afford the £££ to justify themselves in court.

Indeed, and that has been restated several times by the government in defence of the proposed changes to the GRA, so it should be true, but:

  1. The civil service has issued conflicting legal advice stating that gender and sex have the same meaning in law.
  1. The GRA clearly says that holders of a GRC must be treated as the opposite sex in all circumstances.
  1. I don't think this exact issue has been tested; but related legal cases have resulted in putting tranvestite male sex offenders in women's prisons despite very valid safeguarding justifications for not doing so.

Even if sex based exemptions to the EA will stand up in court, nobody wants to use them because of the risk of loosing (see girl guides).

Signed. Women in prisons have also generally already been victims of abuse/male violence. They shouldn't be put at further risk in prison.

Polpotnoodle would you think it was safe to put a man into a women’s prison, regardless of what he’s there for? Logically that would be an unsafe thing to do.

Karen White had not transitioned. No surgery, no hormones, no GRC. Only trans because they said so.

What makes Karen White or those like them less of a risk than any other man? There is no tangible difference.

Why is someone’s right to go into the prison of the opposite sex more important than the rights of the female prisoners to be protected?
