To ask you who should pay....

Person A and person B out drinking after football match last Sunday.
Person A has no pocket so asks person B to put phone in their car parked next to pub.
Person B doesn't want to be seen opening car when quite drunk. Security +police close by. Could be seen as possibly going to drive....
So person B puts phone in their pocket.
Phone drops from pocket and screen now smashed to bits.
No insurance apparently - iPhone also so diy repair a no-go.
Person A says person B needs to get it fixed. Person B has no issue with this but are they a soft touch?
To you the mn jury......

It was A's responsibly- should have brought a bag with them if no pockets.... where were they storing their money?

Person A is both an idiot for coming out with an expensive and uninsured valuable with no way of storing it and a massive CF for suggesting Person B should pay for it.

Person B was a prat for offering to carry it, though. Person A got to the pub okay without pockets, why could whatever they were doing with the phone originally not continue?

Person A. It is their phone and their responsibility. They might consider insuring it next time!

I'm sure Person B wouldn't have paid person A's fines and taxi's etc if they were found guilty of a drink driving offence and banned.

Person B is an idiot. Opening a car door isn’t a prosecutable offence. It doesn’t, in and of itself, indicate an intention to drive. But Person A shouldn’t expect people to holster their phone. Pfft - both irritating.

If I was person A, I would not ask person B to pay. However, if I was person B I would offer to pay. Compromise.

Person A has some bloody cheek asking person B for the money! If I was B I'd probably offer but if I was A no way would I accept. B was doing A a favour.

Person A. They should take responsibility for their own things. If you give a valuable phone to a pissed person, it's your own fault if something happens to it.

For future reference, you can unlock a car and put things inside it when pissed. Just don't go anywhere near the driver's side

Person A should take responsibility for their own stuff. Taking a phone with nowhere to keep it and expecting someone else to take responsibility for it is a dick move.

So A had been carrying the phone all through the football match - not having any pockets - but then wanted B to take care of it when they got to the pub. Did A have any money on them, and if so where were they carrying it?

Either a)A should have taken full responsibility for the phone and continued to carry it, b) borrowed B’s keys and stashed it in the car themselves c) had the for sight to wear a jacket or other garment with adequate pockets.

In any case, fully A’s responsibility.

iphone screens are pretty easy to diy. I would say B offers to repair it if A wants an applestore job B pays the cost of the oem part only.

I wouldn’t have opened the car either

In charge can include attempting to gain entry to the vehicle and failing, having keys to the vehicle, having intention to take control of the vehicle or even "being near the vehicle".

Person A should bring a bag, hold the phone in their hand, or wear something with pockets.

Person B was doing their dumb friend a favour. The phone smashing was an accident, avoidable if A had dressed better.

Person A pays.

PS Why couldn't person A take B's keys, and put the phone in the car themselves? Why could only person B take the phone to the car? Person A sounds a bit helpless.
