to think that people should shut up about their bank charges? You incurred the charges, so pay up.

honestly, i've got a friend who just got £5500 back and he's off on holiday with the proceeds.

he's absolutely USELESS with money and knowingly incurred all teh charges, so why exactly does he deserve to get the money back? it's not a bloody savings account he's been paying into...

I thought in most cases you could arrange overdrafts that you only get charged the interest on?

I agree that if it's the bank's fault, which in some cases it is then people should NOT be charged, & the charges are pretty steep initially, but it's not that hard to avoid them.

I think in general we seem to be in a culture where many people believe that they are entitled to everything even if they can't afford it. If that was the case I'd be driving around in an Aston Martin right now & hoping that someone would waive my bank charges so I could pay for it!

& I'm not exactly rich, have used my overdraft plenty of times, but because it was prearranged it didn't cost me extortionate charges.

I don't see how they are lying though, every single thing that anyone I know had on their accounts mentioned the charges that could be incurred.

lawyers charge you £50 to write a letter, it doesn't cost them that much. i really don't see the correlation between what something costs a money-making company and what they charge you, that's what business is about. however, the OFT has ruled on it so things should change, but that doesn't mean that i think that if you willingly and bullishly incurred the charges over a period of years then you should get all the money back.

shiny, you are being really weird about this. i've written loads of posts, you know what i think. why are you responding as if i think something different? just because you get to let out some of your anger? no thanks.

and fff, i don't think i'm being particularly unreasonable but i thought it might make for an interesting discussion and it has. it's covered lots of topics, occasionally even the OP and has kept people talking all day.

i'm off it now, though, as i can't be bothered discussing it any more, there's nothing new to be said at this time of night. clearly the majority is a firm, sometimes hysterical, YABU. that's really interesting to me, so thanks mn jury - always a pleasure, never a chore.

yeah the banks are the bad guys here not the people claiming their money back. I think people wouldn't be so pissed off if the bank had charged them the £13 or what ever the charge should be rather than being greedy and charging them 30 odd pound when they really cannot justify charging that much. I think it really doesn't matter how reckless you have been with your money, the bank still has no right to charge you more than double of what they should be so people have every right to be angry and claim their money back.

i can and do compare it to a service. i am comparing it to a service, that's my whole point. i know that under the law it's not, hence the fact that the OFT has ruled and people are getting their money back. my point is that if you've wanked about on your bank account for YEARS then i'm not sure that you should get all of your money back. and if more people had responded to that point and fewer to some imagined slight against families living on the breadline then it would have been a much shorter thread.

I am on the fence because i can see it from both points of view. The thing with threads like these is they become so long because eveyone comes out of the wood work and starts sharing their life stories (like me!) even though its not really what the thread was about in the first place, well i know what i mean

i posted the OP knowing exactly the legal position, though, that wasn't news to me, although it may have been to others. that's why i am (albeit incorrectly) comparing it to a service, because i see a continuum there.
anyway, are you a scots lawyer or an english lawyer? i had a legslation question the other day, can't remember what it was right now but will pester you if i remember...so watch out.

well that's clearly the case, but i am nevertheless irked to have my wealthy pal phsl at the fact that we've done without sky tv, any holidays for four years, have struggled to keep within bank rulings etc etc etc and he hasn't bothered and is now off to mauritius with what he calls his 'bonus cashback'. gggrrrrrrrrrrr.
