CFN Thread #9 (Better call Planning)

Okay so I wasn't going to post until I'd had some kind of resolution. However, planning called today to ask if they could access my garden on Friday as they need to do some "further investigation" and have another planning official who will be there to oversee it??

They wouldn't tell me over the phone what it was about (it wasn't Nice Planning Lady, it was someone I hadn't spoken with before)

Thanks pp for the thread title - which coincidentally was very apt!

No sign of CFN/ builders etc.

There's now a sign up saying
NO ENTRY IN TO PRIVATE GARDEN
CONTACT SOLICITORS NAME if you require further information.

Having older properties that look out over other people's garden is not that uncommon... This one sounds unusual in that it sounds a conversion of the building and therefore the central courtyard has been split - and the only sensible option was for only 4 of the 6 flats to have access to their own bits of garden... But there's a vicarage near where I live that has a cottage next to it - and the cottage was clearly once in the same ownership and use - but now the cottage is in different ownership and looks out onto the garden at the side of the main house, although it does have access at the rear to it's own little courtyard (over looked by the back of the main house!)

I was just telling mr fucktrumpet about ur situation and he's asked if you have spoke to other neighbours who also have a garden ? Reason being, it may also be I their interests to raise concerns with planning ? If by sum miracle they are allowed to keep their doors it would set a presidence for the other non garden flats to do the same x

Yes I'm not sure why/ when it was decided that the flats should be divided in this way. However when I bought my flat complete with PRIVATE GARDEN it was all clearly explained.

It's just ridiculous that someone could either a) Be so incredibly stupid to think that they can just carry on REGARDLESS and do what they like, without informing ANYONE
b) I don't have another explanation

B) they think they can install doors, give the illusion of garden access withought saying anything then quick sale they swan off into the sunset leaving new owners to deal with the mess. Not everyone is good a checking deeds ect

However wattyy you have been to quick if the mark I think the thought you'd wait to speak to them maybe write a letter but they weren't counting on the planning officer!!

Where is the freeholder in all of this? Legally it is very likely they own the wall, not cfn.

Watty - the question is whether CFN will decide that, not content with access to YOUR garden, they'll also decide that they want doors out onto their neighbour on the otherside's garden TOO!

Have you searched online for a copy of the original planning permission for the conversion, which would have drawings attached. It looks as though the window removed was essential to the character of the building. Is the listing general or does it refer to any specific features?

I don't see how illegal doors would set a precedent because they're doors that don't lead to anywhere seeing as the garden land is in private ownership.
