I would also call 101 as they are trespassing. They worst they can say is it's not their problem but I don't think unreasonable to ask.

They can't check if you have cctv as it could be on a window ledge or hidden anywhere else they can't see.

Time for a note through their door OP telling the owners that the garden is private property and they are not allowed to go into it, and that includes their builders. No need to tell them that you contacted planning etc. Just make it clear that you do not give permission for them to access your garden.
I'd also stick a note on the patio doors saying the same.

Another thought - can you do the land registry property search thing? Isn't it possible to look up who owns a property on a government website? Then you can google them and find out if they're actually property developers or something?

I would be inclined to put a sign up saying it was private land and they would be trespassing. Then set up cctv on the windowsill. And call police whenever you catch them.

Oh and take photos of the new doors through the window- make sure they are waiting in the planner's inbox on Monday morning.

To be honest, I'd start to contact police and solicitors, explain the situation and get some advice. It's your garden. If they had knocked a wall to have access to your living room, they would be also trespassing. Your flat is worth more because it has a garden, in the same way that maybe the 3rd floor flat is worth more than the 1st floor flat because the former might have a loft, or one flat with a garage versus a parking space. You need to take this seriously, they surely have received news by now. Who doesn't call the builders to check everything is fine? They might have changed the doors to visually fit with the rest, so they are thinking of planning permission and the like, but not thinking about your ownership of the garden. They probably think it's shared but I'd worry that if you let them use it, they might have some kind of rights to claim shared ownership down the line. Stop it in its tracks, report it, keep an official record of your disapproval, etc

As others have said - photographs, notice and log the recurring trespass and potential harassment/threat with police even if they can't come out and do anything. Send it all to the nice lady in planning as well.

CCTV can be set up very cheaply to record to home computre.

Stick a copy of the note on the patio doors facing in , in case it's just the builders who have been going into the house and they don't open the note through the door.

Fuck me this just gets worse! I'd be tempted to take leave just to stop cunty builders in their tracks next time they're there (with NNDN as back up/witness) but obvs it's not exactly a practical solution Confused

Ciggie butts would have been straight through the letter box along with any other rubbish I had to had because I fly right off the handle!

You need to block those doors immediately, nothing to damage them but to stop them gaining access to your garden. You are fully within your rights to secure your property.

I would also buy security/motion camera from amazon to film them- sounds like you'd be able to set it up looking out of your window rather than having to mount one outdoors so would be pretty cheap.

I personally would take out the line about the contacting you to put it right and gain access. Let them figure out what needs to be done, don't be accommodating at this stage.

If the builders turn up tomorrow and the police are unwilling to come out try saying that the builders action is likely to cause a breach of the peace, that might be more effective.

Yeah I would call 101 because no legal knowledge at all but does the fact they are contriving a notice from the council change it from a civil case- Tresspassing to something more??? That might be complete crap though as I say no legal knowledge. Do photograph everything!! I don't think the butts need saving for DNA though Wink. Keep a copy of the letter you send but yes I would also tap something to the doors into the garden for any builders too!!
I reckon they think as your doors were approved if they have doors similar to that they are more likely to get approval!!
