Hello everyone, new thread as requested. hopefully MNHQ could be so kind (as they already have been) to verify that I'm the OP from the original four threads?

A twist in the plot...NSK is actually the CFN and he is watching with glee as he leads OP astray with ideas about the Chinese lady. He cleared away the rubbish last night.

Described the CFN story to my property lawyer friend. He was ShockShockShock that anyone would even think to do this.

However, the bad news is that (although he's talking from his knowledge of Scottish law and practice) he says it could take months for the Planning people to work through their enforcement process (assuming that the CFNs resist it) before it would even land on his desk. And even then, he would have to give them a chance to rectify the situation which could take a few more months.

He would be surprised if the window was reinstated by winter Shock

He did advise that you should also be taking your own legal approach to this - that might actually get quicker results than the enforcement process. Confused

He was also concerned (as others on these threads have been) about the structural integrity of the building, if the new patio doors are wider than the window they replaced. And that the Building Regs Inspector might also have words to say Wink

Also different timezone and my Saturday is just getting underway, been up two hours and had coffee while catching up on this thread on world news but I fully intend to be very productive for the rest of the day and have plans to keep checking this thread every 5 minutes do so much while out and about. Yes, I am definitely going out to run errands, definitely. Just have to make sure my phone is fully charged for checking this thread important texts and emails. Right now I am definitely thinking about about getting showered and dressed too, yes will do that any time now, can't waste the day in my pjs sitting around refreshing this thread surfing the Internet, can I?

DEFINITELY GET A LAWYER- listed building and pp aside, they are obviously trying to appropriate your private garden, and you need to take action against them also, before they try and lay some kind of misguided claim.

Yes one of my siblings has a building/landscapes contracting business which specialises in listed buildings and landscapes and says similar - it will need to be rectified but the process isn't quick in some areas.

He operates under English legislation and said the structural route is usually faster if they have eg not put proper RSJs in and widened the window area.

He also likes to tell the tale of the property developer who "accidentally" chopped down a couple of protected mature oaks in the middle of his development site (having bought it cheap as the trees limited development scope).

He calculated on the inevitable fine being easily recouped by property sales.

Sadly he not only had to pay the fine and extensive legal bills but was also ordered to replant with replacement oaks of reasonable degree of maturity in the same spot. The area was also ring fenced and protected and the whole site was uprated.

Cost the bastard a fortune in lost development value :)

C8H1 - yes, I'd forgotten my friend mentioned that the need for an RSJ might make matters quicker.

Unless of course, CFNs want to do two lots of repairs: first to put in the RSJ to make the building safe and then subsequently to take it out again to reinstate the arched window ShockConfused

....but that would also mean two lots of disruption for poor Wattyyy - plus an extended period of the CFNs having a full length view of her in her garden - very different to the limited view from a kitchen window Sad

I've been following along, what a set of threads!

Watt, as entertaining as this has all been, I do hope it doesn't drag on and on for you and that you get to enjoy your garden before winter comes.

This thread gave me the fortitude to deal with my own CFN! It's a mild scenario in comparison but they were cutting through our garden when they shouldn't be and instead of being passive about it, we dealt with it directly - emboldened by this thread, I like to think!
