I can't believe this is the fourth thread.

To summarise: CFN have seemingly done a disappearing act, my friend is now OUTSIDE the shop but still talking to the shop owner man.

I'm waiting on the wine I can see in her hand.

Two serious points.

I genuinely don't get why the CFNs are anathema.

Playing devils advocate here... Barry and Julie aren't dangerous criminals and if they can establish a right to the Garden then why can't they share it?

Mumsnet seems to always subscribe to the 'mine mine mine' & 'I was here first' grabby grabby philosophy makes me wonder if it's the parents or the children posting sometimes.

  1. it's not their garden. Opening patio doors onto a garden does not make it yours.

  2. that's a listed building they've just knocked a ruddy great hole in.

  3. they've ignored the stop notice and disposed of the brickwork they're going to need to put back as close as possible to how it originally was.

For that they would need to agree to PURCHASE a right to use the garden from the person who currently owns it. How is it ok to simply take things?
Sure, once upon a time we took land from wildlife. But this is where we are now. If you happen to be a landowner but all you own is a small private walled in garden where you feel safe, you shouldn't have to sell some of it off/a right to use it off to some strangers just because they broke the law and damaged a listed building to create a potentially dangerous doorway that could, possibly, cause the wall around the doorway to fall into it if its not properly lintel-ed

Actually no.

The reason why is caveat emptor. All land disputes are case by case and a judge would decide whether or not compensation is required or not based on the merits.

If OP was never entitled to exclusivity in the first place then she (possibly) would not be entitled to compensation.

I do not actually expect any change in the situation for potentially months now. Poor OP has to put up with an eyesore of a door along with the risk of a wall falling into her garden until someone is forced to restore what was lost (removed on purpose) which could even take years :( (sorry OP)
