If it were me, I wouldn't hide from the neighbours if they come round, they may be genuinely hard of understanding, but I would have a script ready along the lines of "My deeds/plans clearly state that the garden is my private property and that you have no right to access it, and your builders have made a complete mess of my garden which I am very unhappy about, and will expect you or them to remedy. The council planning chap/ess is coming tomorrow and we'll see what they have to say. In the meantime, you should know that if you enter my garden I will have no option but to call the police and report an intruder. Now if you'll excuse me, I have a delicious home-made steak pie in the oven."

If you're worried about the safety of your building structurally, councils usually have a dangerous structures team and mine have a 24 hour number.

Planning enforcement officers have a statutory right of access - they need to give 24 hours notice to enter a dwelling, any attempt to block is a criminal offence so the NDN can't refuse to let them view the property to see what else has been done.

They might be able to get matching bricks at a reclaim yard. Some of the bigger ones have a fantastic selection of old bricks. They might have to pay big money to get a reproduction, wooden window made though. We've recently had our windows replaced. We live in a conservation area and so they had to be made identical to the ones we took out. They look fantastic but cost a fortune. Serves them right though if they tried to do this without permissions.

Although how on earth a building firm can take on a job on a listed building and not check is beyond me. Surely that's the bare minimum you'd do?

We used to live in a listed building and had to use specific paint!

So, 6 flats and 4 gardens, and some flats overlook two gardens and some only overlook 1, is that it?

What's outside Fort Boyard this building? For some poor souls is their only view of a garden one they can't use?

Planning won't need to see the inside initially, they will be able to see the breach and can serve formal notices on that basis. The most common way planning breaches are picked up are reports from neighbours and bin men so they don't usually get to see inside straight off.

I'm guessing they hired someone miles away who didn't have a clue and maybe doesn't about listed buildings. This is shocking! Have they now got a massive hole in their flat? I bet another NDN will be fuming!

I live in a block of flats with no gardens. Cheaper than having gardens. some people will barely be home to notice.

I'd love a garden, but then if that's how these people feel they should have bought a flat that had one!

The local conservation officer is your friend here. Around our way, they are utter nazis to the extent that replacing a rotten window, like for like, informing them of every step - you know, trying to do the right thing, nearly gave me a bloody nervous breakdown!! However in your case, it could be a really brilliant thing. It's awful that they have wrecked such a lovely window - and all for nothing. I'd keep out of it now & let the council bods do their thing. Light the blue touch paper & retire OP!! (But I would tell the upstairs neighbours in case the cowboys have compromised the integrity of the structure).
