We have some open land behind our house. After reading this, I might extend the boundary of my garden fence. Clearly if putting a door in to access a private garden is the done thing, stealing some public land must be as well!

That's the same as us. Worked well until neighbours in the next street, whose garden backed onto our garage access put a gate at the bottom of their garden into our access road to use as a shortcut (they don't have garages so no rights to use the access road). Howard, the elderly bloke next door to us, put them right on whose access it is and their gate has gone Grin

I'd be concerned about the structure of the building taking such an integral window out. Perhaps discuss with planning tomorrow as they might send local building control out to assess whether it needs propping pending structural survey.

It's not much different to me deciding to knock through to my next door neighbours dining room then seeking retrospective planning permission...,

Anyone know what'll happen if they are not here when the planning people come? I don't know if it'll matter as I can let them in to the garden. Gladly. But I presume they'll need to see the inside of NDN flat too.

I don't see the builders coming back either...

Unless newdaddie is joking I think this illustrates that there clearly are people out there selfish and deluded enough to assume they can just claim anything they want, regardless of who it actually belongs to. They call it 'cheeky' instead of 'theft' to legitimise it to themselves but theft it is! Sounds like this is going to be a very costly mistake for them but hopefully they'll learn from it.

I'm going to go against the grain here and say that they've made a mistake due to a misunderstanding of their entitlement. Id definitely search the address and see what was listed as part of the sale on rightmove etc. One person has said 'I'd do the same' and his reasonings make him sound like an idiot - you'd never be able to reclaim land people have bought in the way suggested without signing over your land, which you wouldn't do. Everyone else thinks it is outrageous. Your neighbours are going to be devestated but have no right to take that out on you. Don't fear their reaction. I think you will find that, once they realise their mistake, they might be ok. Worst case scenario would be that their deeds say they have access. Then someone has seriously fucked up.

I assume you can't access the gardens without going through a flat? You might need to be on the lookout for the planing people. Do they have your details?

@CoffeeWithMyOxygen it's not stealing, my solicitor advised me that the correct term is expropriate.

Wink  @mickeysminnie the point is that if I can successfully expropriate said property than it isn't someone else's property, it becomes my property. Grin
