To think the result of this rape trial is disgusting

Man gets off completely Scot=free for raping a 12 year old girl, and that this result gives such a wrong message to men, in a world in which girls are never considered too young anyway. I'm enraged!

He didn't rape her, he did not know her age. He, like everyone else that night, thought this girl, out in the early hours of the morning, thought she was over 16. Ffs! He had a one night stand with a girl he met, like many other 19 year old boys and girls do! I feel sorry for him. I feel sorry for her, her parents should have been looking out for her, they weren't. Poor lad has to pay the price.

No she cant consent to sex! He wasn't aware of that. I'm sure he assumed most 12 yr olds would be at home with there parents. Not her fault of course, but not his either!

He has quite correctly been labelled a sex offender by his conviction because he is. No matter how many apologists op up to try to excuse it.

Did he do it deliberately? No. is that a defence in law? For the man who killed someone with one punch? For the woman who overtook at the wrong place? For the lad who unwittingly passed the bad drugs to his friend?

Um... Intention is one of the biggest aspects of any criminal case. If you can't prove intention, you can never get a conviction at the highest level of the law. Lack of intention doesn't mean a crime wasn't committed, but you're not going to get a murder conviction if you can't prove intent, for example.

I haven't read the full thread but this is heartwrenching, I particularly wonder at all the witnesses who couldn't tell she was 16 - surely even when speaking to her they could tell the difference ... too many biases going on here and assumptions which particularly for the police very poor.

For what it's worth in Scotland at lest sex with a minor (13-15) carries the same penalty as statutory rape anyway.

And? People who are completely innocent of crimes have pleaded guilty to things before. On the flip side, people who are blatantly obviously guilty of a crime will often plead not guilty. Pleading guilty is neither here nor there in this case (or any other).

'The man that killed with one punch' assault is a crime. Having sex isn't. So non comparable.
If she didn't have parents, then I'm assuming she was failed by guardians, social services etc. she was most definitely failed by someone. A 12 year old out in the early hours, having 'consensual' sex is most definitely being failed by someone. The 19 yr old boy having a one night stand with a girl he thought was over 16? No, sorry, I don't agree

At 12 I was 5'9 with wide hips and F cup breasts. I also had a fairly deep voice, no hint of a baby face, and because of my height and curves, an adult woman's wardrobe.

People regularly confused me for someone in their 20's. When I went places with my 9yr old sister, people assumed I was her mum. At school new teachers and students would always mistake me for a teacher despite the uniform. I could go to R rated movies, go to clubs and buy alcohol without issue. At 13 we moved to the US for a while and I had no problem getting into some very strict 21+ establishments.

If I'd said I was 16 the part people would have questioned was that I wasn't older. There's no way anyone could have known my real age without asking for ID, and people don't tend to do that when hooking up with someone unless the other person actually looks underage, which apparently this girl didn't.

He picked up a drunk girl at a bus stop at 4am and had sex with her. He didnt see her safely home, or go to meet a sober woman. Even after Ched Evans and Brock Turner, its still acceptable for men to do that.

Statutory rape is there for a reason and also applies to some vulnerable adults, not just underage girls.
This girl has been let down very badly by whoever is supposed to be raising and caring for her.

You can disagree as much as you like, but the law is the law. You can't be convicted if the elements can't be satisfied. I've studied law. It gets on my tits when someone who's never looked at the law thinks that they know what's what.

I wouldn't. The defence that this man used is in place for a reason.

I wouldn't change the law no. But there has to be some common sense used. If a girl looks 16, tells the boy they are 16, it is reasonable that she could be 16 and consented to sex. Then it isn't rape. Can you not see how this would happen? Do you have sons?
