I can see the MP voting to stay in.

So, a legal decision by a Supreme Court, based on law is bullshit?

Sure.

RufusTheSpartacusReindeer · 24/01/2017 10:41

Yabu

Its democracy in action

If they had sorted all this out before the vote or made sure that everyone knew the referendum was advisory only and would have to go through parliament we wouldnt be in such a mess

Its a complete fuckup

I think the MPs will vote to leave, we are going to look like a right load of twats if we don't

Oh and the roast potatoes FFS...i like mine golden brown

Love #alternative facts

OliviaStabler · 24/01/2017 10:42

MP's should not get a say. The people voted and it was to leave.

fleuricle · 24/01/2017 10:42

Rachel I am not beside myself with happiness or glee.
The whole thing has been a dogs breakfast.
And, millions of people will potentially remain unhappy at the end of it.
But, you must admit, the idea of current Govt appealing to the EU over this latest SC ruling would be richly ironic?

Chippednailvarnishing · 24/01/2017 10:44

I blame Dave Grin

QuestaVecchiaCasa · 24/01/2017 10:44

Well I for one am very pleased. On referendum day I found that the things I liked about the EU were balanced by those things I didn't like. For the first time in my life I exercised my right not to vote. My preference was for Parliament to decide.

Things have moved on since last summer and I do regret that I didn't vote. I would now vote remain and if my silly MP (who very pro remain) has done a 180 degree turn around is reading she should bare in mind that her role is to exercise her full judgment about whether something is right not just jump on a band wagon.

chocolateworshipper · 24/01/2017 10:44

YABU - it is a legal decision by a Supreme Court, based on law

Redpony1 · 24/01/2017 10:45

It's only delaying leaving, not stopping, we will still leave

MadHattersWineParty · 24/01/2017 10:45

Bushymuffmum I think you need to read up on what democracy actually means. It doesn't mean you can just have whatever you want to the detriment of your country/fellow citizens. The referendum (not vote, it's a different thing) was unlawful. If we really have to leave, and lose a lot of the rights and funding we enjoyed under EU law, we have to make sure it's done lawfully and as fairly as possible.

This is damage limitation now.

shovetheholly · 24/01/2017 10:46

I urge you to read the actual judgement. It is closely argued but not too difficult for anyone of average intelligence to understand

www.telegraph.co.uk/news/2017/01/24/brexit-ruling-supreme-court-judgment-full/ This is about how the constitution works, not about some political point.

LarkDescending · 24/01/2017 10:46

There is no appeal to the "EU" (or indeed the ECJ) from a decision of the Supreme Court. The decision is final and binding.

shovetheholly · 24/01/2017 10:47

Apologies, wrong link. Here you go:

www.supremecourt.uk/cases/docs/uksc-2016-0196-judgment.pdf

derxa · 24/01/2017 10:48

You say we have to leave, but with what terms? I haven't a clue. I voted to Remain because the whole Byzantine task of leaving is just madness. Also I want to be part of Europe for many historical reasons. However there was a referendum which indicated a desire to Leave. I didn't agree with that result but if we go against it now it will cause political chaos.

The80sweregreat · 24/01/2017 10:48

What happens if an MP voted remain but the overall vote in their constituency was leave? This has really muddied the waters again. I don't think parliament is surprised though, a few politicians I heard speak on the weekend already seemed to know which way this would go. It makes sense for them to have a vote on A50. Just going to be interesting to see how.

Olympiathequeen · 24/01/2017 10:49

No. MPs are not there to vote on what they feel is right. They are there to represent the will of their constituents! ,

Sierra259 · 24/01/2017 10:50

Yes "the people" (well about half of them) voted to leave in an ADVISORY referendum, answering a black and white question about an extremely complex undertaking. It's absolutely right that our elected MP's should get a vote on kickstarting the whole mess - and I still believe they will - not the unelected PM and her cronies. I thought a rather large part of the Leave argument was to escape the powers of unelected officials? Hmm

ChazsBrilliantAttitude · 24/01/2017 10:50

I am very glad the Supreme Court has ruled on this point of constitutional law as they did. I don't think it will change Brexit but it will ensure that Parliamentary Sovereignty is upheld as a concept. This ruling is not just important for Brexit but as a reminder that Governments cannot just rely on perogative powers to change the law in the UK without consulting Parliament.

OP - you really need to make an effort to understand this. Papers like the Daily Mail are coming out with their usual bollocks interpretation but most vaguely normal commentators understand the importance of this case and its implications beyond Brexit.

Learn about representative democracy v direct democracy. The powers of a Government to act without Parliament and when they must consult them. The nature and status of referenda in the UK.

It really annoys me that people who have been complaining about the EU unilaterally imposing regulations on the UK bypassing Parliament (not saying this applies to the OP) then start complaining when the Courts have to block the Government from unilaterally imposing legal changes on the UK bypassing Parliament. If you start allowing a Government to ignore the constitution when they are doing what you want where do you think it will end? What happens when they start doing things you don't want? How will you stop them the checks and balances have broken down?

Cherryskypie · 24/01/2017 10:51

'I urge you to read the actual judgement. It is closely argued but not too difficult for anyone of average intelligence to understand'

There's your problem right there.

MsHooliesCardigan · 24/01/2017 10:51

You know the EU also issues laws about bendy bananas? Hmm

LarkDescending · 24/01/2017 10:53

And, OP, YABVU to dismiss this country's constitutional law as "bullshit". The scrutiny by Parliament of the acts of ministers of the Crown, long established since the English Civil War, is a cornerstone of our democracy.

As for the EU policing roast potatoes, that's bullshit.

Cherryskypie · 24/01/2017 10:53

It's quite depressing to see the depth of ignorance here. It's not really a surprise though having heard the 'logic' behind people's decisions to vote leave.

MorriH · 24/01/2017 10:53

However small, it does give me a slight ray of hope for all this mess

AntiQuitty · 24/01/2017 10:53

Gosh, OP, aren't you ashamed of your ignorance about how our democracy works? You've just "fought" to get it back from the EU and yet you don't actually understand how we are governed.

chipsandpeas · 24/01/2017 10:54

What happens if an MP voted remain but the overall vote in their constituency was leave?

Then I think that MP will be out of a job at the next general election if the MP goes against how their constituency voted

HookandSwan · 24/01/2017 10:54

I agree it's bullshit. We voted to leave so we be allowed to now start the leaving process.
