We were supoose to get paid yesterday, were given a load of excuses by the account eg "I only process on a Monday now payment will be after". Today there is still no payment in my account. I have no gas, no food and need to get the last of my Christmas shopping.

It's not base transfer, we've had issues before where she hasn't paid until the Thursday (fortnightly pay on a monday). I've emailed and text my boss but no reply. Aibu to feel angry and let down, I work so hard, cover when I can etc.

Definitely contact ACAS. You have the law on your side and they will more than likely be open tomorrow. I used them for an employment dispute about 15 years ago and they were really helpful and acted as the mediator between me and shitty ex-employer.

As others have said unfair dismissal can't be used, but I hunk from reading your posts that there is an issue with pay - in which case I'd look at unlawful deduction of wages with ACAS. Good luck

Make sure you also claim for bank charges due to your wage being late.
If they have indeed sacked you I would not hold your breath for your final pay packet, but ACAS will sort it out.
You have to start off with early conciliation which is when a mediator is appointed. You do not have to speak to the other party, it all goes through the mediator. It is totally free.

Ok this will totally out me but I think previous information would anyway but the owners are solicitors. Which makes me concerned about what I'm up against.

Unfortunately this government have been busy eroding employees' rights.

Tribunals usually incur costs now for employees and have quite strict eligibility - as it's an unfair deduction of wages would it be worth just issuing small claims procedure if they don't pay you?

The trouble is as you've been there such a short space of time they will be able to get away with fucking you over in terms of dismissing you, (if I were you I wouldn't want to work there anyway) but you absolutely should be entitled to be paid for the hours you have done. I just think small claims will be quicker, more straightforward and less expensive for you.

Perhaps post in legal or employment, if Flowery is about I'm sure she will give you some good advice.

oh I'd rather eat my eyeballs than work there again, sadly. Too much has happened for it to be rectified. I'm concerned about money and yes I think maybe small claims may have to be and option. Sad I never wanted it to come to this.

I run a business and the fact they are solicitors makes no difference to an unpaid wages claim. It is very straightforward. You do not need small claims. They will be holding back to see if you go to early conciliation, as soon as the conciliator speaks to them they will cough up.
Do not forget adding to your claim any bank charges and if they want to sack you with 6 weeks notice you should also get paid in lieu of notice and your accrued annual leave pay too.

if you are low income the tribunal is free, however most employers cough up at early conciliation

I've read my contract (as you can imagine it's like a book) and from what I can see manager has breached it big time. Contract states two verbal and one written warning before dismissal even during probation. Non of these I have had. unless gross misconduct. This is not gross misconduct. It also states any training or certificates will be sorted by the company. etc etc.

I would make sure the owners are aware that he's appointing his friends. Either if your supervisor can raise that or, you have nothing to lose, raise it yourself. Appointing friends ought to be enough to get the scattiest owners' eyebrows raised, because if he's prepared to be unscrupulous enough to do that, he's hardly going to be supervising them properly is he?

Also there's a possibility if they're from abroad that they don't have work permits etc, which may explain why he was so keen to get them employed there-they couldn't get employment anywhere else.

oh thank you again for all your kind words. I do feel like I've been caught in his trap a little. He's "well known" in the area. Very eccentric (as i said before not a bad thing if you work with it) and a little odd. I guess people in the past have backed down because of 'who he is', yeah, I'm not that woman. I certainly will not leave the others in the state their in either. They're all worried who's next!

just an update for anyone who was/interested. I have a job interview on Thursday for a fabulous position. Pay is sorted (fingers crossed, will see oh Tuesday), the owner and I have been in regular email contact to sort this. Fingers crossed for Thursday.

This is awful for you I don't know where you stand legally on this issue. This happened to me many years ago I remember my boss was getting grief from his bank. Once or twice he had to pay me from his wife's bank account in cash. You don't need the stress of wondering whether your money's gone in or not. Time for pastures new.
