We were supoose to get paid yesterday, were given a load of excuses by the account eg "I only process on a Monday now payment will be after". Today there is still no payment in my account. I have no gas, no food and need to get the last of my Christmas shopping.

It's not base transfer, we've had issues before where she hasn't paid until the Thursday (fortnightly pay on a monday). I've emailed and text my boss but no reply. Aibu to feel angry and let down, I work so hard, cover when I can etc.

Grinch I lurked when you first started this thread and lost it but hoped you'd got paid!

I can't believe they've done that! Can you go to a tribunal? It's unfair dismissal isn't it! I'm sorry they've done this

msgrinch · 30/12/2014 15:44

As the business is so new we're all still under probation. So legally I doubt there's anything I can do. Hoping the owner emails me back. Sad I'm so angry as I've done so much for that place.

Sounds like unfair dismissal to me. Have they paid you all the money they owe too?

Purplepoodle · 30/12/2014 15:45

Time to get onto acas. Start a diary of all conversations, phone calls, keep all emails.

Chippednailvarnish · 30/12/2014 15:45

Did they pay you?

msgrinch · 30/12/2014 15:49

I'm still owed money from the last pay plus the hours I have worked on this payroll, holiday pay and notice (as in the termination letter they have stated they will pay me until Sunday even though I don't have to work it.)

I will give acas a ring. One reason stated is about lack of food hygiene certificate. I have been on at them for weeks to send me on the course. How is that my fault?!

OP posts:
DeWee · 30/12/2014 15:53

Have you got evidence (emails/witnesses) that you asked them to do this?

msgrinch · 30/12/2014 16:01

yes I do. I have both.

OP posts:
PointlessResolutions · 30/12/2014 16:04

After 6 weeks they don't need a reason. Sad But the obvious one is 'demanding to be paid the wage she's owed'. I'm sorry, OP, but you are well shot of these people. Do chase them for what they still owe you though.

CantBeBotheredThinking · 30/12/2014 16:07

I'm so sorry that it has come to this. Flowers

Unfortunately to claim unfair dismissal you need to work somewhere for 2 years unless it falls under the equality act.

msgrinch · 30/12/2014 16:08

Thank you. It's for the best I guess but I still feel so betrayed.

Take them to a tribunal for unfair dismissal.

ToomanyChristmasPresents · 30/12/2014 16:17

You've nothing to lose now from contacting the owner directly and giving them a time line. If I owned a company, I'd be appalled to think that someone wouldn't be paid their wages on time, made even worse because it was days before Xmas, and then fired!

Thereshallbeaspirin · 30/12/2014 16:19

Toomany, OP can't take them to a tribunal for unfair dismissal. She's not been there 2 years so this avenue (in these circs) is not open to her.

Varya · 30/12/2014 16:20

Same for me. Due 28th of the month but not been paid. Called the office and was told it will be on 31st. Cheeky lot!

msgrinch · 30/12/2014 16:23

I have contacted the owner and detailed everything. Waiting for a response. having Brew to calm my anger

AbiAbi · 30/12/2014 16:45

I think you could claim unfair dismissal as you have asserted a statutory right of employment and they have repsonded by terminating your contract.

AbiAbi · 30/12/2014 16:46

Ps - obviously sorry to hear this; there are some utter buggers out there.

HelenaDove · 30/12/2014 16:46

Ive been following this thread and this is appalling. Unfortunately PPs are right. Thanks to this gov you cant claim unless you have been working there for two years.

Disgusting. Sacking you because you want the wages owed to you.

How long have you been there OP Sorry if its upthread and ive missed it. Do you think they just took you on for the run up to Christmas but led you to believe it was permanent which is not unheard of either.

msgrinch · 30/12/2014 16:48

I've been there 6/7 weeks (business opened in October). I have no idea if that could be the case. Possibly, yes.

OP posts:
AbiAbi · 30/12/2014 16:50

Two year qualifying period doesn't count for 'automatic unfair dismissal' which is what this is, she asked for her wages which she is legally entitled to, and they responded by sacking her.

Frikadellen · 30/12/2014 17:00

Wow I wasn't expecting that development So sorry Msgrinch. I was reading your post before Christmas.. Hope you get a much better job in 2015
