We were supoose to get paid yesterday, were given a load of excuses by the account eg "I only process on a Monday now payment will be after". Today there is still no payment in my account. I have no gas, no food and need to get the last of my Christmas shopping.

It's not base transfer, we've had issues before where she hasn't paid until the Thursday (fortnightly pay on a monday). I've emailed and text my boss but no reply. Aibu to feel angry and let down, I work so hard, cover when I can etc.

I agree with AbiAbi. But must admit I am not an expert just relying on HR friend's input.

msgrinch · 30/12/2014 17:07

msgrinch I have been lurking on this thread too. That manager is an utter bar steward. Cannot believe you got the sack.

Just want to wish you well really.

msgrinch · 30/12/2014 17:14

Thank you so much. I'm really gutted as i loved it there. Sad he's the only problem. He's destroying their business. I'm not the first he's sacked for no reason in the 6 weeks.

Definitely give ACAS a call. You have a statutory right to be paid for the work you do so if the dismissal is as a result of you questioning not being paid/being paid the correct amount then your dismissal is automatically unfair. The two year qualifying period does not count in these circumstances. They will more than likely argue that it is for other reasons and will cite all sorts of spurious crap - lack of hygiene certificate, conflict with colleagues etc. Make sure you log all calls between you and them, keep all emails and try and write down everything that was said and has happened. Source: used to be a shop steward.

msgrinch · 30/12/2014 17:31

I have just received a lovely email from the owner (made me tear up actually). Stating that they have given manager control on staffing and can't do much to overturn any decisions as they don't know all the details. Also thanking me for my professionalism and the way I have handled the matter, thanking me for my kind comments etc etc.

So that's that avenue stopped. I guess acas will have to be the next route.

Sounds like they are trying to keep you sweet so that you don't take it further. I'm sure of they really wanted to, the owners could find out the circumstances and overturn if necessary.

HelenaDove · 30/12/2014 17:46

Agree with Napoleon. Its all bollocks to try and keep you quiet and try to get free work out of you.

TickleMyTitsTillFriday · 30/12/2014 17:46

Jesus op. So sorry. To me it sounds like the owners are being a bit wishy washy. They should be straight onto creepy manager to pay you what you're owed.

msgrinch · 30/12/2014 17:46

I think that too. I also think the email was sent by owners wife as it was quite unlike him Grin . Onwards and upwards I guess.

If any of you are in West Sussex area and need a hard worker. Please let me know!

They sound like the sort of company who would be very happy to use workfare if they got the chance!

msgrinch · 30/12/2014 18:07

The new manager was very keen on employing 2 eastern European girls that used to work for him before and rent off him. ones started, I've just been told the others start Monday. I think I've been removed to make way for them.

Shock The story just gets worse and worse. Good luck finding something better!
msgrinch · 30/12/2014 18:42

Thanks! I'm on the job sites now. Hunting away. I've applied for a few things already. Trying not to let it get me down.

Crossing my fingers for you! Onwards and upwards!

raltheraffe · 30/12/2014 19:53

It is breach of contract and you can legally claim for your wage and incurred bank charges. Speak to ACAS.

msgrinch · 30/12/2014 19:54

do you think acas will be open tomorrow?

OP posts:
raltheraffe · 30/12/2014 19:55

They cannot just sack you without a reason and if you have been sacked you are entitled to notice pay.
If you have 2 years' service you can go for unfair dismissal, if indeed you have been sacked.

msgrinch · 30/12/2014 19:55

Thanks toomany! Keep them crossed Smile

sadly only 6 weeks as it's a new company. Their reasons are pathetic and my supervisor is backing me up. I think manager has a plan to be honest.

OP posts:
Corygal · 30/12/2014 19:57

It's illegal not to pay you on your contract date. Point that out and demand redress asap. If that doesn't work and/or you think she might try it again, talk to ACAS who will make trouble.

WhereYouLeftIt · 30/12/2014 20:06

Well the owners absolutely deserve for their business to go tits up then.
