to just remove the bloody bolt?

Sorry, this is petty and quite long, but the situation has descended into war over a bloody gate and I'm bloody fed up with it

I live in a little housing estate which is situated on the edge of a village, to one side of us is another housing estate, the other open fields. All bar 2 houses are owned by our landlord, he also owns the road, our access track, etc, etc.

In the corner of our house is a gate which leads into the housing estate behind us along a footpath. It's got one of those Chubb locks on it but we are all allowed to use it and have all been given keys

This gate is the only access we have by foot into the village. The track out of our estate when you're driving is about 4 miles round along narrow, windy, country lanes to the village, school, shop, etc. all has been fine and we've all been living here, sharing the gate and going about our business happily for years

About 2 months ago a new neighbour moved in and has complained endlessly about the gate and there have been a few disputes about it.

About a month ago the new neighbour added a slidey bolt to the gate and every time someone went out through the gate, he'd slide across the bolt, meaning you couldn't get back in. This wasn't terrible if someone was around to come and open the bolt, but several times we've all been stuck the other side of the gate.

More disputes about this bloody gate ensued and the Landlord got involved. Landlord removed the bolt and warned the neighbour.

So, this morning I go to use the gate to take DD to school, to find the bloody bolt is back and neighbour has now added a padlock

WIBU/illegal to remove the bolt and shove it up the neighbour's arse ?

you can if you employ an official company on private land which this is.

i looked into this when i had nightmare neighbours that kept parking on my drive.

Well surely if the gate is nothing to do with him and the LL has told him not to bolt it he's not doing himself any favours!
And if all tenants have a key so that only they can use the gate, what moored does he want??

His actions need reporting to the police anyway to build up a dossier as this will carry on and escalate.

No gate = everyone blocking the driveways again.

diddl he wants the gate closed off permanently as he doesn't want random people using it.

There were problems years ago with lots of parking/people using the gate but it was solved by the addition of the lock long before he moved in, no clamping or ticketing or anything was required.

NN needs to just stop pissing about with the gate, only key holders can use it, he's making mountains out of non-existent molehills.

Fixing a bolt to a gate won't constitute a breach of tenancy, not enough for a court to evict him for.

What is it with self important neighbours?! Sounds like some penguin bollards might be required Sad
Defiantly do the record keeping and reporting to police just in case this escalates.

That's what I mean-if there is a key for tenants, how are "randoms" using it?

If he is stopping other tenant's access by bolting it, is that not a breach?

Please photograph it and keep a record. Maybe even ask police to build up a dossier as pp suggests

Evicting someone for breach of tenancy isn't easy. It would be easier for the landlord to just give a section 21 notice, but even then that is not a quick fix. The rules about eviction are not straightforward.

Depends on whether he is blocking an established right of way.

This at least comes under being a nuisance neighbour and anti social behaviour, as well as other bye laws.

If he is on a three or six month trial, he can be instantly evicted.

I don't understand why he's been allowed to get away with what he has been.

I have a vision a war will start now and will end with a line of bolts with padlocks going right down the gate. maybe group together with the rest of the place and all of you knock on the door together to ask him nicely to knock it off.

I wouldn't knock on his door, I would pester the LL, he must be on a trial tenancy and who knows how far he will go.

I would remove the bolt, put a sign up saying if anyone wants to claim the bolt, to contact the landlord, not you. Email landlord and let them know what you've done - or go withthe calling the letting agency on the hour, every hour until it's removed. They might not have the sort of contract where they have to do maintenance, but that level of pestering, I bet they will be able to call the landlord to sort it...

Hope you managed to get the bolt off ok, Stinkle and left your note telling the owner of it that they can come to yours to collect it! Although if I'd found this thread earlier, I'd have suggested you tell the NN to collect the bolt from the LL, as that's where it will be. Just so he knows full well that his new gatebolting activities have been flagged to the LL.

What an utter cock he must be - and as PPs have said, why the fuck would you move into a place like this when you know about the communal gate and its use? Twat. Angry

Let's hope the LL decides to let this one go, eh - although it would probably depend on how easy it is for LL to get a new tenant...
