to just remove the bloody bolt?

Sorry, this is petty and quite long, but the situation has descended into war over a bloody gate and I'm bloody fed up with it

I live in a little housing estate which is situated on the edge of a village, to one side of us is another housing estate, the other open fields. All bar 2 houses are owned by our landlord, he also owns the road, our access track, etc, etc.

In the corner of our house is a gate which leads into the housing estate behind us along a footpath. It's got one of those Chubb locks on it but we are all allowed to use it and have all been given keys

This gate is the only access we have by foot into the village. The track out of our estate when you're driving is about 4 miles round along narrow, windy, country lanes to the village, school, shop, etc. all has been fine and we've all been living here, sharing the gate and going about our business happily for years

About 2 months ago a new neighbour moved in and has complained endlessly about the gate and there have been a few disputes about it.

About a month ago the new neighbour added a slidey bolt to the gate and every time someone went out through the gate, he'd slide across the bolt, meaning you couldn't get back in. This wasn't terrible if someone was around to come and open the bolt, but several times we've all been stuck the other side of the gate.

More disputes about this bloody gate ensued and the Landlord got involved. Landlord removed the bolt and warned the neighbour.

So, this morning I go to use the gate to take DD to school, to find the bloody bolt is back and neighbour has now added a padlock

WIBU/illegal to remove the bolt and shove it up the neighbour's arse ?

Don't pop a note through his door - do as Lucked advised and leave a note on the door asking for the person to know for their property back. Remove it with witnesses and then make sure you have someone with you when he calls around.

DoJo · 25/06/2014 13:37

He ran over a bike which was on someone else's property? What a wanker! I would just take a screwdriver out there, remove the bolt and post it through his letter box.

Shallishanti · 25/06/2014 13:38

I would just remove the bolt and say no more about it.
I assume you are 100% sure it was he who put it there?
take a photo first as evidence, send to the LL
but no reason you or other neighbours should be inconvenienced.

TwelveLeggedWalk · 25/06/2014 13:38

He sounds horrific. How many of you are there? It sounds, otherwise, a lovely place to live.

Do you think if he pisses the landlord off sufficiently he might get his tenancy revoked.

DoJo · 25/06/2014 13:39

Whoops - cross posted a million times! I think your idea is a good one, but contacting the landlord is a more long term solution as they are the ones that should be taking it up really (and hopefully, if it causes enough grief, they will just end his tenancy).

diddl · 25/06/2014 13:40

I'd take the bolt & padlock off, inform the LL & give them to him when possible.

specialsubject · 25/06/2014 13:44

another situation where you can be grateful that this is a rental and that your awkward neighbour is also renting.

inform the landlord (BTW you are entitled to contact details which should include a phone) and let him deal with it.

AgaPanthers · 25/06/2014 13:51

What a cunt. Complain frequently about him to the l/l, hopefully he will be evicted in due course.

LisaMed · 25/06/2014 13:51
  1. I think it is a legal requirement for the landlord to provide you with an address. IIRC there is all sorts of stuff around it. If there is no problem then don't go poking around but if the landlord is getting a bit difficult then you may be able to grumble about that as well. The trouble is that upsetting landlords often leads to eviction.
  1. I would really recommend all your neighbours keeping a written record of all this. It sounds like Jobby will continue to cause problems and a concerted written record from all the neighbours could be really useful if the police get involved. With this type of nutter the odds are fifty fifty it's the police or the daily mail.

I love the idea of acting all innocent and not knowing who would do such a heinous act as cause so much trouble for so many without any good reason. Take off the bolt, leave the note and say that you will be handing in the bolt to the local police station for the person obstructing to pick up. You do not need to sign this note.

Good luck.

Stinkle · 25/06/2014 13:56

Thanks - will leave a note on the gate asking for the owner of bolt to come and collect it

I'm assuming LL is at work, he's always really good with stuff like this and is really hot at replying to emails and correspondence, so I'll remove bolt and leave LL to him to sort out properly

I'm hoping NN pisses LL off sufficiently that he'll revoke the tenancy. He's already had a warning from the last time, although I'm not sure whether it was official

Twelve. There's 8 houses. It is lovely down here, NN excepted

Other neighbour reported bike-gate to 101, but police pretty much refused to do anything citing the fact that this is a private road but I'll check it out

Thanks!

Wow! What a total dickwad. Hopefully he will make enough of a nuisance of himself that the landlord will refuse to renew his tenancy. Hate people like that.

EhricLovesTheBhrothers · 25/06/2014 13:59

He can't revoke the tenancy, it's illegal. He can refuse to renew though.

PoshPenny · 25/06/2014 13:59

Other neighbour need to let landlord know about the bike incident. hope you get this sorted, new tenant sounds a nightmare.

steppemum · 25/06/2014 14:01

Ehric - can't he give the tenant notice if he isn't honouring the tenancy agreement?

brdgrl · 25/06/2014 14:03

Are you absolutely certain that he hasn't leaned on landlord himself and worn him down through obnoxious behaviour, so has gotten permission to do this?

TreadSoftlyOnMyDreams · 25/06/2014 14:05

I think that you should all do the school run with a hand bell, the noisy kind that small children love to use.
Then if you get stuck, you can repeatedly ring the bell until a neighbour comes and rescues you.
I should think that the noise level should make him rethink his bolt fairly quickly. Grin [ grin]

What. A. C#ck. !

gamerchick · 25/06/2014 14:06

sounds like it's time to remove the gate completely. You'll all cope with a gap I would think.

Nomama · 25/06/2014 14:08

As long as Agents know LLs address it is fine as it is assumed that you would ask if you wanted to know. But if Agent says no.... then there is something up.

But it sounds like Stinkle's LL is out enjoying the sunshine rather than being a crap landlord.

Stinkle · 25/06/2014 14:08

Oh, and just to add, no the gate isn't attached to his property in anyway.

Just typed out the worlds longest description but it's hard to describe, but basically the gate isn't attached to his house at all and all access to the gate is via shared land

OP posts:
Nomama · 25/06/2014 14:09

Gamer, they'd have all the other mummies on their cars back again, blocking the road andfcausing chaos.

Nomama · 25/06/2014 14:10

steppemum, once the contract is signed it is hard/impossible to evict during its term. But the LL can refuse to extend/renew it.

gamerchick · 25/06/2014 14:10

I dont understand that, it's a footpath how can it be blocked by cars?

Stinkle · 25/06/2014 14:14

I thought he could revoke the tenancy if he's breaching the terms of the tenancy?

Although, I don't think it specifically states that you must not add a bolt, despite already being told not to, to the communal gate (yet Grin)

If NN is on the same terms as all the rest of us, NN will have a 6 month tenancy to start with which is then extended, which means we (fingers crossed) only have about 4 months of this nonsense left.

Removing the gate altogether is definitely tempting. Or some kind of structure on each side to give us a leg up so we can climb over it, or a rope ladder maybe Grin

steppemum · 25/06/2014 14:16

gamer - as I understand it, there is a culdesac with a gate at the end in the fence onto a footpath.

The mummies from the school come and park in the culdesac and go through the gate onto the footpath, as it is better than driving round and trying to park near the school. The gate was locked to stop the mummies, but all the people living in the culdesac have a key.

steppemum · 25/06/2014 14:17

remove gate, put up sign saying private road and get a couple of large clamps for the mummies cars!!
