i am really annoyed with this. i moved from my last home for my neighbours parking their vehicles in our spaces and it got really nasty. we have since moved to a new development where there are set rules about what you can and cant do re: parking and vehicke types its ones of the reasons i bought the house. My new neighbours are basically flouting them even though they have been warned by the developer.

aibu to expect for people follow the rules that are set, and not take the piss.

its been handed to the solicitors now i hope this can be resolved ir ill be moving again.

rules are worded to say no work vehicles with a capacity more than 600 kilos. or something like that. my house kinda faces half of the house opposite and half the parking.

i don't know what was deleted fuckarama, mn has rules too see?

I just actually just had a thought.

This Volkswagen transporter. The one the guy has been polishing and cleaning.

My neighbour has one of those. Looks like a van.

Except it's adapted for his terminally ill wee boy who is in a wheelchair. They rarely get out with him in it because of his difficulties, so it barely moves.

It's black, the van-that-isn't-a-van.

Bottom line. It's not a caveat on the mortgage.

It's a covenant on the deeds.

Covenants can be negative or positive - you must keep that tree, you must not park a van over x size.

They will be different for every house, so unless you go to the Land Registry and look up the files, you won't know what restrictions are on the deeds of the other houses.

Your solicitor should be able to do this for you - but he/she will charge for it. You can do it online for yourself and not involve a solicitor.

Also, any restrictive covenant can be lifted, depending - usually you have to pay a whacking great fee.

So how do you know that your neighbours haven't paid the fee to get the restrictive covenant lifted?

I expect your neighbour will be rather surprised that the first he has heard of it is a solicitors letter. It probably won't make him feel terribly well disposed to be considerate of you.

Why don't you just ask about it?

I live in a ' new ' development . It has the same rules . I paid above the odds to live here and I don't want to look at a van . You have my sympathys!

because they knew they where in the wrong when questioned about it. why would the developer and my solicitor be involved if they had.

plus as a part buy home they only own half and they would need permission from the housing association.

This mightg really fuck you off op, but a friend of mine lives on a simelar new build set up, with simelar rules regarding cars and parking etc. She couldnt care less but her neighbour sounds just as fucked off as you. The developer got involoved and it all went to court...long and short of it the courts were unwilling to effectivly make the guy homeless over parking a vehicle for employment purposes. Regardless of what the terms of purchase were. The vans stayed.

What about "vans" that have been converted to take wheelchairs OP? Is there any signs this might be the case with the ones parked outside your house?

Whatever kind of vans they are, YABU. If the developers saw firt to sort it they would've done it in time, without you getting a solicitor involved.

How do you know that the same covenants are on the common people's houses are as on your naice detached house?

Maybe they thought the commoners might need to park vans and things to they can be deserving poor and work for their keep so the covenants aren't on their houses?
