She was close to the nephew apparently- this can happen in families. But quite frankly that’s just arguing the toss. I mean, he was 19. I would not wish my 19 yo to go on a highly questionable, ridiculously high risk ‘adventure’ of this nature- really, would you? No one can possibly think that’s ok.

They were so confident of her unsinkability that they provided the minimum number of lifeboats they could get away with, which turned out to be nowhere near enough for the number of passengers.

That doesn't mean that they believed that it was unsinkable.
It means that they just chose not to provide enough for everyone because they didn't have to.

Waivers are not always ironclad, and it is not uncommon for judges to reject them if there is evidence of gross negligence or hazards that were not fully disclosed.

“If there were aspects of the design or construction of this vessel that were kept from the passengers or it was knowingly operated despite information that it was not suitable for this dive, that would absolutely go against the validity of the waiver,” said personal injury attorney and maritime law expert Matthew D. Shaffer, who is based in Texas.

OceanGate could argue it was not grossly negligent and that the waivers apply because they fully described the dangers inherent in plumbing the deepest reaches of the ocean in a submersible the size of a minivan.

The degree of any potential negligence and how that might impact the applicability of the waivers will depend on the causes of the disaster, which are still under investigation.

"There are so many different examples of what families might still have claims for despite the waivers, but until we know the cause we can't determine whether the waivers apply," said personal injury lawyer Joseph Low of California.

OceanGate is a small company based in Everett, Washington, and it is unclear whether it has the assets to pay significant damages, were any to be awarded, but families could collect from the company's insurance policy if it has one.

Families could also seek damages from any outside parties that designed, helped build or made components for the Titan if they were found to be negligent and a cause of the implosion.

OceanGate could seek to shield itself from damages by filing a so-called limitation of liability action under maritime law, which lets owners of vessels involved in an accident ask a federal court to limit any damages to the present value of the vessel. Since the Titan was destroyed, that would be zero.

But OceanGate would need to prove it had no knowledge of potential defects with the submersible and would carry the burden of proof, which legal experts said is a difficult burden to meet.

If OceanGate were to fail in such a case, families would be free to file negligence or wrongful death lawsuits.

"the media say" ..there's the problem...most of the media haven't had a clue when it comes to this operation and have been thrashing around filling air time speculating....worse still the level of technical knowledge they have displayed has been at times utterly dire - not understanding the difference between radar and sonar for example.

If you step back from the noise and crap the media have been generating and instead only consider what the actual coastguard and other experts involved directly in the search have said there was zero speculation, and for example no mention of regular banging and distress signals (they just mentioned noise).

As for the speed of the discovery today...not really surprising...if you were running the search then as soon as you had an ROV on task and without compelling evidence to do otherwise you would send to down to the intended destination of the missing vessel...so no real mystery about why the wreckage was found so swiftly once an ROV arrived...

I don't want to be morbid (RIP to everyone aboard) but this is why I had no hope from the beginning and didn't even follow the story. My brother is a submarine enthusiast and he said right away, when the story first broke, that the sub was now the size of p3psi can, if it'd leaked and the incredible pressure under those depths had been the cause of the catastrophe. I was never able to forget that imagery. It was difficult to have any hope after listening to the odds.

I hope Oceangate gets bankrupt, new laws are made and nobody is allowed to go on such missions anymore. Human life is too valuable.

The possibly good thing my brother said was that de@th would have been instantaneous. The passengers, once the event happened, would have simply ceased to exist, no pain or suffering involved.

What makes me even more fearful is that the poor 19 year old is said to have been absolutely terrified ahead of the trip, and according to his aunt only went on it to accompany his father, who was titanic obsessed.

All hope is lost. It seems the US navy's SONAR did pick up an anomaly around the time the Titan went off comms. So it happened early on, not after days trapped, and it was very fast. Other than a rescue, that is the best outcome for those men, but so damn sad.

It's desperately tragic, of course. Most people are sad for their families who knew them. But unless you did, you don't need to continuously think of the victims.

Confirmation bias, look it up. We have no way of knowing what actually happened inside that vessel and this sort of mumbo jumbo is deeply unhelpful and distasteful.
