OH had an affair with a member of staff. Can he fire her?

My OH recently had an affair with a member of staff ie someone he employed. She works in a very close environment where they can’t easily escape each other. What can be done, legally? I’m in pieces every time he leaves for work. Can he sack her? Could I dismiss her if I became a director?

He's cheated and your looking at ways to make his life easier at work so you don't have to deal with the reality of who he is.

I'd be spending my money on a lawyer to protect my financial interests in the divorce rather than risk that money being paid out for an unfair dismissal trial and compensation.

You cannot sack someone because your husband cheated. 🙄

Sack her for what exactly? No, of course he can’t (legally, she’d likely take him to the cleaners if he tried). If I was you, I’d be more concerned with my cheating H and how I was going to deal with the smithereens of my marriage….

Has she been employed there for more 2 years?

If not, then she can legally be dismissed. The only claim she could have would be if she was discriminated against in terms of age and disability.

Morally - why should she lose her job because your OH can't be trusted to keep it in his pants?
If not her then it will be someone else. Will you sack all female members of staff just in case?

He should see a solicitor and get advice on settlement agreements (essentially a binding agreement that she leaves in exchange for a pay off).

Blimey, so the affair was just this woman’s fault? As shit as this affair was for you, why should the other women lose her job? Why don’t you divorce your husband instead?

If he's going to sack her, I suggest that you get your divorce settlement sorted first. Otherwise there might not be much left once his legal bills are sorted.

I get that you're upset about the affair, OP, but it reflects very badly on you that you want this woman sacked. Your OH is the one that has cheated on you, and he's the one that you should be angry with.

The two year period doesn’t apply to discrimination including sex discrimination - which this would likely be. Your OH would be on very shaky ground dismissing her.

Give your head a wobble OP, unless you want to be facing a huge lawsuit for unfair dismissal. He's the problem, not the woman.
