OH had an affair with a member of staff. Can he fire her?

My OH recently had an affair with a member of staff ie someone he employed. She works in a very close environment where they can’t easily escape each other. What can be done, legally? I’m in pieces every time he leaves for work. Can he sack her? Could I dismiss her if I became a director?

Very dodgy legal ground if she is dismissed. It can be done but only if she'll play ball and he's willing to fork out a sizeable amount.

Has she been employed there for more 2 years?

If not, then she can legally be dismissed. The only claim she could have would be if she was discriminated against in terms of age and disability.

Morally - why should she lose her job because your OH can't be trusted to keep it in his pants?
If not her then it will be someone else. Will you sack all female members of staff just in case?

I disagree with part of this. It's a claim of any protected characteristic discrimination, including sex. I expect it's very likely to be indirect discrimination.

I’m presuming he doesn’t want to just find a new job because he owns the company? Unless the company is large, it will probably take its entire value to pay damages if she is sacked, so he might as well just quit now.

Your husband fucked one of his employees and you want her sacked. It's him that could easily get sacked for abuse of power. She's not the villain in this. You must surely know that.
And of course you can't become a director in order to sack her. Unless you want a law suit.

Only because I would imagine boss having affair with someone he employs could be gross misconduct in some industries and maybe it should be him who loses his job.

Either way I think you should be more focused on getting him out of your life than getting her out of his.

Either way I think you should be more focused on getting him out of your life than getting her out of his.

It sounds like it is his company so he won't be fired despite his unprofessional behaviour and abuse of power.

However, if he further abuses his power and fires the woman in order to appease the OP, he will no doubt face financial consequences. I imagine she'll take him to the cleaners.

I worked somewhere where my boss got the sack for having an affair with a woman who reported to him.

He was in a position to affect her pay rise/bonus amount, promotion requests etc. and hadn’t informed HR of the conflict.

The woman stayed working there for several years after he had to leave.
