Employer have said I have resigned - I haven't. Urgent help please!

I have a loooong thread in AIBU and received excellent support but things have escalated.

Long story short, I went on maternity leave this time last year. I had issues at work throughout my pregnancy, being shouted at and sidelined and told to move locations. Sorted it all out informally.

In March I asked to return to work early from Mat leave due to financial issues caused by lockdown. At this point my boss attempted to move me again, that didn't work and she then went back on the hours she had given me and it messed up my childcare.

I raised a formal grievance and put a flexible working request in at the same time. The company failed to do anything with my request and the grievance process was mismanaged and a data breach occurred in the middle of it, where my grievance letter was upload to a public file and seen by others.

The grievance was upheld in parts but they again tried to move me to a new location which doesnt work due to childcare issues.

I requested mediation with my boss in order to go back to work as I'm still not back 7 months later.

Today the regional director has said that they won't honour mediation and I have now resigned.

My union rep has disappeared and I received this at 16:00 today so couldn't get hold of ACAS.

Any advice would be very welcome!

OP I've just read your thread from start to finish and just want to say- what a fucking ballbag of shite incompetents they are. I am so sorry you and your family have been put through this. As if a global pandemic wasn't enough right now. You sound amazing and so strong- I'm really, really rooting for the absolute best outcome for you.

I've worked civil service for years and I thought I'd seen all levels of ridiculous incompetence in this area but this is a whole new ballgame Confused

Won't your solicitor update you? She'd have to discuss any offers with you, so it sounds like the other side aren't actually doing much at all. You'd think they'd just want it gone!

She's been great with keeping me in the loop and like you say, she'd need to update me on offers etc. Very likely a delay on the other side.

just read all the way through, and remembered your first post. Sometimes these fools just dig their heels in for the sake of it - it is as if they have never been challenged on their shitty behaviour.
I will never forget the joy of getting a £15K payout from my shitty company in 2000 under an unfair dismissal. I asked to have my dad help me, and I think they laughed to themselves. Little did they know he was a regional union manager and tribunals were his bread and butter.

I'm going to email my solicitor tomorrow and check in, my rep too as he's my named representative so the copy of the ET1 should have been sent to him and not me.

Just spoken with my solicitor - she hasn't heard anything, there is no wiggle room for negotiation with what we've offered, so it's waiting for the pressure points of the preliminary hearing and getting the bundle together. Although there is a chance that they might want to settle when they have to do their ET3 for my second claim.

Could be here for a while!
