Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It resumed again over 1 to 2 September for closing submissions.
Following handing down of the judgment on 8 December 2025, on 11 December 2025, it was announced by Sandie Peggie and her legal team that they would be pursuing an appeal and it was reported on 3 August 2026 that leave to appeal had been granted with an expectation that the appeal proceedings could take place in court early next year (2027).

He's a respondent in the case.

NHS Fife have accepted liability for any claims against Upton, so they should pay.

If that was not the case, there is a straightforward process for Sandie to get the judgment enforced against Upton in Australia without any need to relitigate the case. She would have to register it in Australia by filing an application with a certified copy of the judgment. Once it was successfully registered, it would have exactly the same force and effect as if it had been issued by the Australian courts.

What's the latest with the complaints to the GMC about Upton?

For the RCN next month is there a way to watch this one?

SP would still have to enforce the judgment though; Australian debt collection process. It wouldn’t be trivial. Or cheap. It’s difficult enough to collect on a judgment in the UK, sometimes.

Any employer worth their salt would want to know if a prospective employee has an outstanding tribunal against them.

Especially when it involves making up allegations of misconduct in order to destroy colleagues' careers

I haven’t seen one but would like to know too. I imagine Sandie’s team might publish their skeleton argument before the hearing but might be a while.

If he gets a judgement against him, I will be sure to write to the relevant Australian authorities. My aunt has dementia and is in care in Kempsey. Kempsey hospital is one of his hospitals so I think I have skin in the game. My aunt has gyno issues and I would want her to have female only care for this.

I think he ran away to Australia because he wouldn’t be able to get work here and because they are convinced men can be women.

No recurring dreams for this one. Perhaps I'm reconciled to this being my fate.

Nadia Whittome, MP and idiot, has written a bleaty article saying what a dark day it is for trans rights (the EHRC guidance comes into force today) and posted it on X.

My favourite response to it: "They could perform gender-affirming surgery on every male in Britain and still not produce a bigger pile of bollocks than you did when you wrote that article."

I live in fife and the A&E at the vic is the only A&E in fife so I have skin in this. I've also had wonderful care for my son from sandie Peggie and am very angry about this and the way the hospital protected and enabled him along with the GMC so whilst he may no longer work in Scotland I want to make sure that hes never in a position to treat an unconsenting women or treat another member of staff the way he has sandie.
I also know that if we can get him struck off or suspended it will protect Australian women too

Australia won't care. Their government is fully supportive of "any man can be a woman if he says so". They really do mean any man, no matter how much a woman may not want him near her.
