to be fair to the staff, it is totally possible that nobody spoke up because of the culture of "be kind" and cancellation and job losses.

And that is why the NHS in general, and the individual trusts in particular must obey the law. It protects their staff and it protects their patients.

I've always thought this was dangerous for female patients.

A very common arrangement is male and female single sex¹ sleeping accommodation, with a shared daytime recreation area. Control of who goes into the sleeping areas is frequently poor, and bedroom doors are not lockable.

In theory there are always staff keeping an eye on things in the shared area, but in practice this offers minimal protection (and only against actual physical assault; not leering, commenting, threats, fear ...).

She didn’t have capacity. The state has stepped in to protect her from herself. That’s what psychiatric wards are for. Only they didn’t protect her. Even though she clearly needed their help or she wouldn’t be an inpatient. Nice victim blaming though.

Exactly! She had been detained under the mental Health Act for her own safety! What was safe about this?

NHS Policy is at fault here. Staff couldn’t question this woman’s choice and advice her of risk without questioning her gender identity which is a disciplinary offence. Family members cant intervene because the NHS policy is to ignore them in favour of the patient. NHS policy says that the patient’s preference must be respected …. Staff will end up being disciplined but it’s the policy makers which should be jailed for this - it’s a corporate failing

Agree - the policy makers should be jailed - they've DELIBERATELY been breaking the law for years. Decimating the ability to safeguard. They're offering up already unhappy women to be raped. Deliberately, knowingly. Causing more harm.

It doesn't say.

But the prosecuting KC said "the hospital is not on trial here; whether it has questions to answer is for a different type of enquiry".

So I really really hope they carry out that enquiry.

A reminder that though the Equality Act is mostly civil law, it does contain a criminal offence in Part 8 112

By 'be kind' I meant affirm and accept what the individual says, eg I am a man (even though biological female) or I am a woman (even though biological male). Then treat as the chosen gender eg put in places for that sex.

Affirm their choices, accept their chosen gender etc....some of these trans individuals have been 'affirmed' by their families, friends, schools and everybody around them since young (otherwise transphobic 🙄) leads to this type of situation. Few people say to them no you can't change sex.

Where I work, be kind, is a thing. Its up.to them what they want to be, so be kind.

How 'kind' is it to require some people to submit to others? Not a fan of equality for all?

How do you decide who are the servicers and who are the served?

Have the servicers consented to the servitude and submission or is this some dodgy BDSM contract you're enforcing? As what, an employer?
