Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It resumed again over 1 to 2 September for closing submissions.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February 2025. Sandie Peggie returned to give more evidence on 29 July 2025.

Personally as this is a case about women's rights I'd prefer to see boiled beetle or nauticant in the role of narrator and illustrator

Truly, it is a thing of beauty.

The section on DU’s credibility with respect to the “contemporaneous” notes is meticulous.

I also want to post something that many reading may not be aware of, outlined in the images attached.

DU was asked via his legal representatives to email the native (original) file of the screenshot of the file history of the notes to his legal team on the morning of the Tribunal when the two IT experts were questioned. This would take mere minutes, and would mean the experts could determine whether the file had been interfered with.

DU’s legal representative emails back at 23:30 that night, after the experts have been questioned. This is a refusal to provide the original files because there doesn’t seem to be a need.

I’m betting on the Judge not allowing the late change by JR because he previously had said no to adding KS as R3 and because making this change won’t materially affect the outcome - her arguments were poor and her case law largely irrelevant.

At the end I was embarrassed for JR. While NC came out looking very informed, professional and on her brief JR did not. Who will want to pay fees for her to say repeatedly “I’ll come back to that”? Ranging from Seriously underwhelming to morally bankrupt… not someone I’d want to appoint or be professionally associated with

The publicity statement during the trial must have had board level approval as must the various amendments

I think at this point suggesting it "must" have had board approval is suggesting a greater competence than the NHS Fife have so far demonstrated. Should have had board approval definitely, but quite possibly was put out by a more junior TRA supporter in the Trust!

There isnt anything to be gained from pursuing so called "friends" . It wont gain Sandie anything and she may wish to remember good times and not go there. They will suffer anyone as no-one will want to be around backstabbers.

I hope they are feeling a bit anxious though, wondering if they may be next on the list. A few sleepless nights are well deserved at the very least.

(I hate backstabbers whatever their ilk).

It's not possible to imagine some board members were not involved at some point during the evening or next day when the new iterations kept appearing, even if the first was put out by someone excessively silly. They would all have had to be in a bunker together to miss the headlines and general uproar.

I think they are only looking at those involved in the press release for the next proceedings.

But there will probably be many others who know they have made grave errors or committed related acts of gross misconduct that haven't yet been found out, and who will be crapping themselves in fear of SP's team catching onto them.

This whole case just reiterates the misogyny involved. Upton LIED to smear Sandie’s reputation and cover his own back. He lied and lied, and people don’t seem to be throwing their hands up in horror. Instead they are focusing on Sandie and dodgy posts in a group chat from years ago. So unfair. Upton should be sacked for gross misconduct.

I don’t think it’s about being a litigant in person, I think it’s about “deadnaming” and “misgendering”, also known as “correctly sexing”, are not actual offences.

But they should be! And if I scream and stamp my feet loudly enough then they'll give me what I want and to hell with everyone else. Or at least that seems to be the legal argument. Dr Upton picked his name for a good reason, but he forgot to add Violet in front of it. (From the Just William stories, where Violet Elizabeth Bott is a spoiled brat with a rich daddy.)

That is a very interesting question.

As per the SC decision, from around 10.30am on the 16 April, he should be using the men's or an alternative mixed sex space.

But I don't think NHSF will have told him to, because it would undermine their case.
