GLP are going after Sarah Philmore and are going to lose

Get the popcorn folks. GLP is getting ready to lose again.

They are going after barrister Sarah Phillimore for referring to a man as a man. They think they are going to lawfare her into silence.

Her blog:

Here we are now: Entertain us
I have had now 7 years and counting of the various tactics used to 'silence' those who won't comply with prevailing orthodoxy. How are those tactics holding up?
https://sarahphillimore.substack.com/p/here-we-are-now-entertain-us?

The only thing is other TAs have already tried this on Phillimore multiple times. They went to the Bar Council their claims were dismissed. They all failed. More to the point this ‘Kate’ is the same guy complaining again who already failed. Sarah Phillimore knows the law and likes explaining it to TAs and making them lose. So she doesn't even resent the attempt.

As Sarah has stated "They pick on someone who not only enjoys this but has now a vast repository of knowledge about the law in this area."

Sarah Phillimore

Because I don’t tweet as a public body, an employer or provider of goods or services. I am not subject to the Equality Act. I tweet as a private individual and I will say again. You can’t change sex. A man cannot be a woman. I cannot be compelled to call a man a woman.

A trans identifying man such as ‘Kate’ who frequently takes to the public stage to urge violence against women and declare his intent to enter women’s spaces, is a dangerous man and one who will attract public comment.

SP's chambers have received a complaint about her. She is blaming GLP for creating an atmosphere of hatred. Countdown to libel action continues.

And so it begins. I have asked Mr Maugham to delete his libel and publicly apologise for it by Friday 5th otherwise I have no choice but to take legal action against him.

His actions have serious and real world consequences.

The content is irrelevant, it is the fact that it is made. As we saw with Allison Bailey and Garden Court, people are expected to over react in terror at such complaints. Maugham knew exactly what he was doing. He has used his reach and influence to attempt to silence opponents. This cannot be tolerated.

JM really has got himself in a bad situation now.

So who is the other barrister and do they know they are about to be lightly accosted by a slightly damp sponge of a complaint?

I think it is Naomi Cunningham.

I will not proceed unless I can get help with funding. My only asset is my house. And it isn’t a 2 million pound windmill. Again, Maugham is very well aware of this. He knows libel action is very expensive. I will see how much money I can raise by either the JKF and/or crowdfunding and I will take it from there.

Unlike Mr Maugham and the Good Law Project I will always be open and honest about my chances of success. If I do get anything in damages it will all go to For Women Scotland.

It is very frightening to consider where we would be now if men such as Maugham are allowed to prevail.

The tweet shows a copy of an email that seems to have been sent to SPs chambers claiming she is 'actively working to damage the rights of the trans community'.

That seems to suggest that Maugham's/GLPs slurs are having a detrimental impact on her professional life and risk causing her serious harm.

I mean, IANAL, but that seems quite damning.

https://en.wikipedia.org/wiki/Strategic_lawsuit_against_public_participation

Strategic lawsuits against public participation (also known as SLAPP suits or intimidation lawsuits), or strategic litigation against public participation, are lawsuits intended to censor, intimidate, and silence critics by burdening them with the cost of a legal defense until they abandon their criticism or opposition.
In a typical SLAPP, the plaintiff does not normally expect to win the lawsuit. The plaintiff's goals are accomplished if the defendant succumbs to fear, intimidation, mounting legal costs, or simple exhaustion and abandons the criticism. In some cases, particularly in the context of investigative journalism, repeated frivolous litigation against a defendant may raise the cost of directors and officers and other liability insurance for that party, interfering with an organization's ability to operate. A SLAPP may also intimidate others from participating in the debate. A SLAPP is often preceded by a legal threat. SLAPPs bring about freedom of speech concerns due to their chilling effect and are often difficult to filter out and penalize because the plaintiffs attempt to obfuscate their intent to censor, intimidate, or silence their critics.

The first anti-slapp legislation in the uk was passed by parliament in 2023. It related to economic crime - One of the act's main aims is to overhaul the companies registry in the United Kingdom to drive out foreign corrupt funds from the United Kingdom economy. The act is further aimed to counter fraud and money laundering.

https://www.thebureauinvestigates.com/stories/2023-10-30/uk-introduces-first-anti-slapp-law-but-critics-say-it-doesnt-go-far-enough/

The new legislation has created an early dismissal process for cases involving economic crime. This means a judge can throw out a claim before trial if they deem it to be an abuse of process. It also gives criteria for what exactly defines a SLAPP and provides a cost protection scheme should the case proceed.
The move is aimed at stopping the rich and powerful from using the threat of costly legal action as a means of suppressing public criticism. However, the amendment is limited to cases involving economic crime only.

It came into effect in June this year.

It is most interesting that anti-slapp legislation was brought in for economic crime first. Its not a particularly well known area by the public. Only people with specialist knowledge of economic law are likely to have a good grasp of it.

That said there is quite a lot of political will to extent legislation to other areas.

Just throwing this random thought out on this thread for no particular reason whatsoever.

There will be more law like this.

The various states in the US are passing similar type legislation. In many cases its to protect public officials as they loose a massive amount of privacy if paid from public funds. And some right nutjobs use that access and other information to file bogus crap with the courts.
One aim is to oblige the nutjob to get permisson from the Court before filing can be accepted which stops other officials having to go through whatever process thus forcing the victim to unwind it

Also, as a call back to JKRs tweet, it's very low effort. They could have found a cigarette, a vape, a joss stick and took the pic on the Mersey Ferry or, I dunno, a pedalo?

If it transpires (and the evidence today is beginning to look heavily like this) calling yourself a mafia is only to serve to demonstrate the following:

2. The definition
Extremism is the promotion or advancement of an ideology[footnote 3] based on violence, hatred or intolerance[footnote 4], that aims to:

negate or destroy the fundamental rights and freedoms[footnote 5] of others; or
undermine, overturn or replace the UK’s system of liberal parliamentary democracy[footnote 6] and democratic rights[footnote 7]; or
intentionally create a permissive environment for others to achieve the results in (1) or (2).
The types of behaviour below are indicative of the kind of promotion or advancement which may be relevant to the definition, and are an important guide to its application. The further context below is also an essential part of the definition.

3. Behaviour that could constitute extremism
Aim 1 (negate or destroy fundamental rights and freedoms): Behaviour against a group, or members of it, that seeks to negate or destroy their rights to live equally under the law and free of fear, threat, violence, and discrimination. Including:

Using, threatening, inciting, justifying, glorifying or excusing violence towards a group in order to dissuade them from using their legally defined rights and freedoms.
Aim 2 (undermine, overturn or replace liberal democracy): Attempts to undermine, overturn, or replace the UK’s system of liberal parliamentary democracy and democratic rights. Including:

Advocating that the UK’s parliamentary democracy and democratic values and rights are not compatible with their ideology, and seeking to challenge, overthrow, or change our political system outside of lawful means.
Using, threatening, inciting, justifying, glorifying or excusing violence towards citizens, in order to dissuade them from participating freely in the democratic process.
Subverting the way public or state institutions exercise their powers, in order to further ideological goals, for example through entryism, or by misusing powers or encouraging others to do so.
Using, threatening, inciting, justifying, glorifying or excusing violence towards public officials including our armed forces, police forces and members of local, devolved or national legislatures, in order to dissuade them from conducting their obligations freely and fearlessly, without external interference.
Establishing parallel governance structures which, whether or not they have formal legal underpinning, seek to supersede the lawful powers of existing institutions of state.
Aim 3 (enabling the spread of extremism): Intentionally creating a permissive environment for behaviour in aim 1 or aim 2. Including:

Providing an uncritical platform for individuals or representatives of groups or organisations that have demonstrated behaviour in either aim 1 or aim 2.
Facilitating activity of individuals or representatives of groups or organisations that have demonstrated behaviour in either aim 1 or aim 2, including through provision of endorsement, funding, or other forms of support.
The dissemination of extremist propaganda and narratives that call for behaviour in either aim 1 or aim 2.
Attempts to radicalise, indoctrinate and recruit others to an ideology based on violence, hatred or intolerance, including young people.
Consistent association with individuals or representatives of groups or organisations that have demonstrated behaviour in either aim 1 or aim 2 without providing critical challenge to their ideology or behaviour.
If any behaviour listed in aim 1 or aim 2 has occurred previously, a refusal by the individual, group or organisation that conducted the behaviour to rescind, repudiate or distance themselves from the behaviour.
