NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #46

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence had been intended to be 28 July with 2 days of submissions from counsel meaning that the hearing was to have ended on 30 July. However, it became apparent as the hearing progressed that this schedule wouldn't be followed. (Considerable understatement.)

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions were provided here:

At the NHS hospital I worked at, the post room was unstaffed and the door was always open. The porters would deliver sacks of post, drop them on the floor or sometimes sort it into pigeon-holes. I would never have known if my post went missing, because there was no log of post received. Terrible system, but probably not the worst in the NHS.

As always, thank you to nauticant for setting up the next thread for us.

I hope Bez is back later because I'm going to have to sign off at short notice at some point. Also it'll be more entertaining cos he's so much funnier than I am😄

I can post TT without comment, until 4pm. It will affect my knitting though.

Have you ever tried the tinned stuff? I bought some from the Campbell's factory but gave them all away. Swerved the tinned whole chicken.

Urghh, sounds grim!

I wonder if NHSF thought some of the messages supporters sent could be used to undermine SP. My largely unfounded speculation.

Thanks for the new thread, OP, and for pulling all the links together. Blimey, this case has been dragging on for a while, hasn't it? Hope Sandie is holding up okay through it all.

NebulouslyContemporaneous · 29/07/2025 12:28

NC's "there have been developments overnight" is reminding me of Columbo's "Just one more thing", as he spins round, dirty mac swishing, just when the baddie thought he was going to walk away.

lcakethereforeIam · 29/07/2025 12:28

I don't think I'd trouble myself thinking about why grown-ass men want to transition. You can't trust them to be honest possibly even to themselves. Ditto why access to sss. The reasons for that can only be purely selfish. The exact reason given is irrelevant imo.

With children who say they are trans it's clearly different.

snickersbarchild · 29/07/2025 12:28

Surely the best thing to do would have been to ask both Sandie and Upton what they wanted to have done with their post? Idiots for just going ahead as even f the motivation was positive it could just as well have been badly motivated.

MeinKraft · 29/07/2025 12:28

I wonder if the overnight development is that the second witness now won’t come forward after all.

Hmmm good point

snickersbarchild · 29/07/2025 12:29

I think there's more witnesses come forward.

snickersbarchild · 29/07/2025 12:29

They've opened up a right can of worms.

Or that someone else from that group chat has come forward to say there’s another reason Lyndsey had it in for Sandie?

Profhilodisaster · 29/07/2025 12:30

I just hope it's something in SP's favour

Lins77 · 29/07/2025 12:31

What I'd expect with the post - given the apparent volume - is that it would be set aside and the addressee (SP or BU) asked to come in to pick it up at some point.

I don't think there's any reason to believe people were sending bombs or anthrax.

tribunalObserver · 29/07/2025 12:32

Tbh give the TRA playbook I'd be astonished if someone hadn't posted dog poo or worse to Sandie Peggie at Victoria Hospital - and given the way other groups glom onto the CLAW when it suits them, not that surprised if someone had done the same to BU.

This is my coaster! 😀

Ah ok thank you! If someone had said "pure fanny" from the start I would have recognised it as a very common turn of phrase among Scottish friends!

Boiledbeetle · 29/07/2025 12:33

Well this is going to fuck with the judges timings isn't it!
