NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #46

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence had been intended to be 28 July with 2 days of submissions from counsel meaning that the hearing was to have ended on 30 July. However, it became apparent as the hearing progressed that this schedule wouldn't be followed. (Considerable understatement.)

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Woops from Fife. Unless they had Sandie’s agreement to open the post, they had no right to do so. And if there were any concerns over potential hate mail or something to be concerned about, absolutely up to Sandie and her family to decide how to handle that, not Fife. Easy enough to have a friend or family member to review them in advance of handing these over in case they cause some harm.

We can add this to the list of things that shouldn’t have been handled like this in relation to this case.

I disagree - in every job I have worked in the post is opened in the post room, logged and then bundled up to go first to the reviewing partner in that department and I only then got it after that partner had seen in it (and in some cases written a note on it with instructions like send a copy to XYZ). I can't imagine that NHSF has a different policy

They need either permission or a reasonable excuse. "The member of staff in question has left so we needed to check if this was something we needed to deal with" is a reasonable excuse. It is not clear that they had a reasonable excuse in this case. That doesn't necessarily mean they don't have one, but it isn't immediately obvious.

not clear to me what the point of this is yet - unsurprising NHSF would vet post arriving before passing it on

TBF this case is so public I think there's a very reasonable concern that either recipient's mail could contain malign substances. Though if that is the concern they should probably have the post vetted by a proper security person or even the police. Is there evidence that was what was happening?

I would think given the circumstances, the correct thing to do would have been for NHS Fife to contact Sandie or her representatives and make an arrangement given there's a high profile court case going on to make sure that no more disasters come their way........................of course, that assumes a belt and braces approach in NHS Fife to doing things the right way and avoiding further harm, but why start with the post!

God I used to work with someone who did things like this. They thought they were being so clever but everyone who came across them just knew what a twat they were. So childish. Not sure someone who intentionally mispronounces people's names for cheap laughs from the peanut gallery should be in charge of attempting to win a case. Couldn't Fife afford anyone better?

Every workplace I’ve been in all
post would be opened by our admin team, logged/scanned and then passed to me. The only exception would be mail marked private and confidential and then I’d be expected to log it/scan it. Work isn’t the place for personal correspondence.

The evidence is that they are vetting post addressed to two specific individuals, not vetting everything. That is what makes this difficult for Fife. If they always opened everything in the post room, that isn't an issue. If most goes through without being opened but post addressed to two specific individuals is opened and vetted, that is problematic.
