NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #46

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence had been intended to be 28 July with 2 days of submissions from counsel meaning that the hearing was to have ended on 30 July. However, it became apparent as the hearing progressed that this schedule wouldn't be followed. (Considerable understatement.)

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

It’s been admitted that at some point in his induction DU was asked about his ‘happiness’ to use the female changing rooms. Unless they ask every female clinician this, then it’s obvious they know what sex he is.

For me this is key to the “mass collusion” nature of the activist standard of “trans acceptance.” It’s not enough to accept gender non-conformity, you have to pretend you a) can’t tell a trans colleague is trans even though you are clearly bending over backwards for them because they’re trans and b) have to slam-dunk your ally status by pretending you don’t even know your own sex, despite sex being pertinent to your professional knowledge.

How can that lead to anything good? All it does is reveal that people can be socially pressured into lying. And as we see here, Fife was much more interested in gathering multiple people to punish Sandiefor not going along with that lie, despite at least one nurse having what I would have considered to be worse dirt on her from seven years ago.

You can really see where the priorities lie.

MC At that time, the Ix not completed. The reported behav unacceptable. One issue with B&H is impossible to think about if dont know about it. Didnt compromise as behav already known. If reported behav had happedned was unacceptable

Yes, they really didn't take it seriously initially. It would be stretching credibility to think that was by accident/poor search skills.

It may have been “not taking it seriously” or it may have been more deliberate. How to tell? It certainly is a serious impediment to justice if one side is not disclosing properly, whatever the reason.

Phew, still not entirely caught up with yesterday's shitshow but here I am.

Just my four penn'orth:

Let's face it, SP sounds bloody awful. A nasty, racist person amongst a wider group of nasty, racist people. Safe to say, we would not get on.

But just think - it's apparently been widely known around NHSF that she's a nasty, racist person for at least thirteen years, and NHSF have done the square root of bugger all about it. If they had actually dealt with the racism at source, they would never have found themselves in this position - because she'd have been, quite rightly, sacked years ago.

As it is, she wasn't and her incontrovertible right to a SSS to change in will mean that she will win this case. She'll probably never work again though.

@Jellycatspyjamas The floods in Pakistan started around the same time as the first peak of the covid pandemic. Can you imagine how nursing staff felt at that time knowing they were dealing with patients likely to infect them and their families, with no or inadequate protective equipment, struggling to get food in the shops, more patients that usual and maybe colleagues dying on them. I very much doubt these were the only examples of dark humour in those 2600 pages.

Covid was also a rich source of jokes on social media, it probably wasn’t very funny to people whose loved ones died of it.

NC has managed to steer it back to lack of proper procedure-following, and, though she hasn't emphasised it as much as I would like😏,the 100% acceptance of DrU's version of events, and the assumption that SP was guilty.

I don't even think that yesterday's revelations of racist jokes can be taken as 'Well she's racist so she's probably transphobic too' because all these doctors say they didn't know SP/ barely knew her before the reported incident.
