Maggie Chapman has publicly accused the Supreme Court of transphobia. Any lawyers know if this is contempt of court?

Why would it be contempt of court? She's neither a witness nor a defendant, or commenting on a trial in progress, or defying any court order.

People really can say what they think. They should say what they think and we should support their right to do this, if we also want this freedom. If Maggie Chapman disagrees with the law, she's every right to organise to change it. What she hasn't the right to do is break the law that exists.

Similarly, if the Labour party don't now agree with the Equality Act they themselves enacted, they can legislate to change it. They have a majority and could do this tomorrow. This is how our system works. What they can't do is ignore the law of the land.

Hoosemover · 21/04/2025 14:16

The woman is a deranged as the men she supports. The Scottish Parliament is a dangerous institution for women. That needs to change come the next election.

It seems odd that a politician, who writes legislation, would call the supreme court “hateful”. Maybe it’s not contempt, but it seems at odds with public office. I’ll google what the oath they make says, I suppose i see this as being contemptuous of the senior court.

She's a right one isn't she.
i don't see how it's contempt of court, but is it a form of slander? Who knows. I heard her speaking about the environment recently and was really shocked, as I didn't think I'd ever heard her speak about a green policy before.

FizzingAda · 21/04/2025 14:28

No, but she's certainly behaving in a way unbecoming for a politician, and is bringing the Scottish Parliament into disrepute (more than it already is).

fromorbit · 21/04/2025 14:32

It is not contempt of court. It is however potentially a breach of the rules for MSPs especially as she is The Deputy Convener of the Equalities Committee.

Gethin Chamberlain

Under the Judiciary and Courts (Scotland) Act 2008 members of the Scottish Parliament must uphold the continued independence of the judiciary. Accusing the Supreme Court of "bigotry, prejudice and hatred", as Green MSP Maggie Chapman did, would seem at odds with this obligation.

The appropriate part of the act is quoted in the link.

Do we have any legal types that can advise?

You can Complain here:

I think it might be breach of Section 7 of the Code of Conduct.

Forgettingblue · 21/04/2025 14:32

She's not one of politics big thinkers is she?

TWETMIRF · 21/04/2025 14:32

Whenever I see or hear her, all I can think of is that she's so stupid she doesn't know if she's a woman or not.

I'm waiting for her to declare that teaching children to wait for the little green man when crossing the road is transphobic as nobody has asked it how it identifies...

She could be in a room on her own and still not be the brightest one there

Seriestwo · 21/04/2025 14:46

Her female constituents are not fairly represented, are they?

Appropriate that she's the new Rector of Dundee University right when the uni is going to hell in a handcart.

Chapman's Trump like attack on the Judiciary is attracting attention. Please please contact your MSP or MP and the press to express your concern and/or register a complaint as mentioned above.

Akua Reindorf KC

As a lawyer I am deeply concerned to see an elected politician publicly undermining the separation of powers in our democracy with irresponsible and entirely false allegations of bigotry and hatred against the judiciary. Disgraceful.

For Women Scotland

Insane comments from an elected politician as she accuses the highest court in the land of "bigotry, prejudice, and hatred".

Remember, this woman is deputy convener of the committee that looked at the GRR, she clearly cares nothing for the law and is unfit to be an MSP.

Also we have footage of Chapman applauding appalling abuse of JKR:

LonginesPrime · 21/04/2025 14:59

This is just like when people called the Cass report transphobic before enough people had actually read it.

The fact that people say this kind of thing about public reports and judgments which can obviously be examined and show no signs of actually being transphobic in the slightest only serve to make others realise that the accuser’s definition of transphobia is fantastically broad and completely different from a reasonable person’s definition of transphobia.

Mp, msp should uphold the independence of the court system. This is definitely not that, it could probably be classed as incitement to riot and to disregard the rule of law.

EvelynBeatrice · 21/04/2025 15:40

Isn’t it ‘uttering the judges ‘, an old Scottish offence?

Things are getting serious. Keep the complaints coming.

Her remarks were described as "utterly disgraceful" by Scottish Conservative equalities spokeswoman Tess White, who called on Ms Chapman to resign from the Equalities, Human Rights and Civil Justice committee

The Press are now on this story:

The Telegraph
Green MSP urged to quit after accusing Supreme Court of bigotry
Maggie Chapman was filmed criticising judiciary following ruling that trans women are not legally women.

Scottish Daily Express
'Warped' Maggie Chapman brands Supreme Court judges bigots in 'appalling' rant after gender humiliation
Maggie Chapman has been urged to apologise after she appeared to brand Supreme Court judges bigots in a rant at an event over the weekend.

The Scotsman
Green MSP criticised for accusing Supreme Court of 'bigotry, prejudice and hatred' over gender ruling
Maggie Chapman made the comments while addressing trans rights protesters over the weekend.

We are on three KCs condemning this now with Joanna Cherry.

Joanna Cherry KC

It is wholly inappropriate for any parliamentarian to speak about the judiciary in this way & to so misrepresent their judgment. This person is not fit to convene a parliamentary committee on equalities, human rights & justice. She should resign her position.

She is like the Daily Mail calling judges ‘enemies of the people’.

SionnachRuadh · 21/04/2025 22:58

I mean I know the Scottish Greens mostly function as care in the community but this is going a bit too far even by their standards

Datun · 22/04/2025 00:14

Ffs. When are the grown-ups going enter their room and stop these fucking lunatics.

The lawlessness of these transactivists is utterly shocking. Our politicians, the police they're all fucking petrified of them.

Daily Mail covering it now

https://www.dailymail.co.uk/news/article-14633103/Calls-Green-MSP-quit-equalities-role-brands-Supreme-Court-bigots.html

Going to be interesting to see the fall out from this. If the Scottish Greens are going to continue to be anti- rule of law in the 2025 election will it hit their vote?

They already appeal to a minority of voters who might not be bothered. However given the SNP might need coalition partners this is going to be a deeper issue. How can the SNP team with a party which has a Trump like attitude to the Law.

Other parties can use it as weapon to attack SNP and Greens and it basically undermines their credibility.
