Having now watched a fair amount of msm have changed from being in celebratory mood to being something akin to a raging Medusa seeing the continuing and increasing woman hatred exposed everywhere, this thread has not helped…apart from JKR and Rosy Duffield of course.

I read in the DT just now that a lawyer specialising education law (new one on me) said they'll be seeking clarity on 'trans kids' wanting to go to the opposite sex school, so girl wants to be a boy and applies to an all boys' school. They say the legal position is not clear and if she's rejected on the ground of sex, she could go after the school on 'gender reassignment' grounds.

I read it too late at night, it made my brain hurt and I probably misunderstood bits. But it sounds wrong to me. Anyone know?

I don't see how that would work as the comparator would be someone of the same sex without the protected characteristic.

An all boys school would deny both on the basis of their sex. That one has the gender identity of a boy makes no difference.

But I'm not a specialist education lawyer (or any sort of lawyer)

Yes it's wrong, she's not being rejected because of gender reassignment, she's being rejected because of sex.

That's the whole point of single sex provision. You're allowed to discriminate on the basis of sex, under certain circumstances. And single sex schools is one of them.

If they took girls, but not her, because she identified as trans, then that would be correct, but it's not the reason. They don't take any girls

In that case can I take the opportunity to blatantly advertise the NHS Policy Audit thread?! A place where you can help shine some sunlight?

Our Scottish audit of single sex spaces made 2 articles in the Telegraph and one in the Scottish Daily Express at the end of March. Our London audit is due to be written up in The Telegraph this weekend.

I’d assumed our survey might stop there but given the disappointing reactions to the judgement, I think we’re going to need to hold feet to the fire for change, while raising awareness to prevent future backsliding…

So the crazy idea is that we now go on (region by region) to prove that there are no single sex spaces left in the whole of the NHS/UK.

It takes 45 mins approx per Trust with some light googling. Full instructions provided and I won’t know who you are.

I’m about to set up the anonymous online survey for The Midlands this weekend and it would be great to have a few more hands on deck.

I am genuinely perplexed how a judgement giving clarity on the rights of 52% of the population becomes a discussion about the effects on 0.05% of the population. It’s pretty obvious to anyone with thinking capacity that if there need to be sex based rights (because of sexism) these need to be based on sex. Rights for other groups should not be impacted by this, also obviously. How could the law have found differently without being a farce?

Well, quite. How often have we been lectured "it's hardly any of the population, it affects so few people, why do you care so much when there are more important issues like the cost of living/ Ukraine/ war in the middle east".

Well, right back at you lads! Why are you getting worked up at a judgment that affects so few people, when some people can't afford their rent?

Tbf to Keir, there is a real risk we may lose some tourists who are coming West on the A85 this Easter in the grand canyon that has opened up just before you get to the coast in Connel but then again that is really the Scottish governments remit if they could only focus on what is important for a moment.
