I keep thinking of more things this applies to: board representation, prisons, NHS annex B, sex pay gap, la leche league, lesbian dating apps, council gyms, private gyms, work changing rooms, refuges, surveys and censuses, school lavatories ... you all know the list. So many things where we've had to argue all round the houses and been met with 'but TWAW', and now we have 'the Supreme Court says'.

Where do we start?

  1. Prisons - because the women in prison have no choice about who they are imprisoned with, and are unable to leave
  2. Hospitals - due to the vulnerability of patients, especially in mental health units.
  3. Schools - for child safeguarding reasons

Just popping in to say that I predicted this outcome on here a while ago so I’m feeling chuffed today. I know many legal commenters were reluctant to make a prediction, but seeing how the Supreme Court loves consistency in statutory construction I really couldn’t see it going any other way. I was amused at the part of the judgment that reacted to the concept of a male lesbian with incredulity and said it would make lesbianity meaningless. I suspect the justices in the Supreme Court are not aware of just how common “male lesbians” are in TRA land.

im guessing, they just get refused on the basis of a visual decision, and if they insist, security is called?

And then if they want to sue, they can. And if they're a man they'll lose, but if they're a woman?

sorry, edited to add, that if proof is necessary, would a cheek swab be taken?

The ruling relates to natal sex/ the sex you were born as. This will be recorded on birth certificates. if there was an issue with regard to someone’s sex being in doubt in relation to enquiries about law breaking, the person under investigation could be asked to present their birth certificate to a police station, as is done with traffic stops.

I think it will boil down to sex registered at birth, including any retrospective corrections of fact. This possibly means some men with DSDs will continue to be legally female, but they are small in number and the issues mostly relate to sport, where the sporting regulator has the power to exclude them based on unfair advantage.

No particular order they should all be sorted ASAP.
It's not like the same people will be working on prisons as schools or hospitals.

Get them all fixed for Tuesday latest. Keeping in mind it's a bank Holiday weekend and the start of a new school term.

Also, for those following the Dr. Upton case in detail, the Supreme Court written judgement explicitly clarified that the right for biological woman to request same sex care means by a biological woman (defined as since birth). So not Dr Upton, a man identifying as women, even if he had a GRC.

There is no reason for hospitals not to be shuffling wards round today they do it all the time anyway.

Prisons might need time to organise themselves. Find space elsewhere.

Schools are closed.

Offices get the memo out no trans in the opposite sex toilets.

They are breaking laws which are now crystal clear.

I didn't know that. So the whole thing about legal privacy gets kicked out of the ballpark because they can be challenged over their birth certificate?

Edited to add, but also, what if they swear blind it is the original. How do you prove otherwise?

I don't know why but what really set me off was Jean Hatchet (I think - I've been reading a lot of posts!) commenting on FWS's 'yaaaaaaas!' twitter post and saying 'this is their roar. Fear it'. Didn't think it would make me cry but it did.
