Watching again. Judge being very careful to say (I paraphrase) "We didn't write the law, that's for politicians; we're just here to ascertain what it was intended to mean."

Which I think translates as: "Don't shout at us and get up twitter mobs branding us enemies of the people. You don't like it, go yell at someone else."

Pondering also whether this judgment means that where the health and safety law refers to facilities for men and women, this can now also be applied? (As was of course the intention of the health And safety regs when they were published, but became blurred by this nonsense.)

The battle isn't over. Kier Starmer and the government needs to be watched closely. They will be lobbied hard by the trans lobby to bring in new legislation that overturns/nullifies/amends the EqA, and renders this judgment meaningless. Parliament is the ultimate legislator in this country (unlike the US, where the Supreme Court has that power). I am hoping KS will just let the whole thing quietly go away now and accept it as settled law, but he will be under pressure by the extreme left wing of his party to fix this.

Yep. How do you prove that a man with a female birth certificate is a man? That's the next challenge.

We're told these men can be excluded from single sex spaces but how the eff do we prove that they are men. Birth certificates show a sex marker linked to a genital inspection carried out at birth. The marker is linked to biology.

Except that the GRC has severed that link and means birth certs are no longer proof of bio sex.

So how do we prove bio sex.

It's the next battle, I agree. But this gives us solid ground to fight from.

Previously, the counter argument was that false documents were fine because anyone with a bit of paper saying they were a woman was a woman, and we didn't need to/weren't allowed to distinguish between certificated women and section 9 women.

Now we can say that this is the law, and the falsification of documents inhibits compliance with the law.

Re Labour I can’t find the pp as moving fast but I think they’d push more against this if their polling wasn’t so bad.

They already have Reform marching on their ground and you can see their shift to counter. They’d be mad to go against women on this. Hopefully they’re not that mad.

I think this entirely supports the interpretation of H&S legislation as being biological sex as would have been the original intention.

Yes, there were always cross dressers and transvestites, but as far as I know, they never claimed to be other than men.

I don’t think there will be much political will to challenge this. This ruling means that obfuscation doesn’t work anymore. The only way to legislate against this would be to expressly state that legal sex overrides biological sex. I suspect that is too overt to be politically tolerable especially given that Labour is not polling well. It would be a political minefield for no electoral benefit.

The Trade Unions are now in a very exposed position too after their biased resolution that may breach the EA.
