It is sad that I don't actually know which way this decision is going to go.

Crouton19 · 21/08/2024 07:59

The hearing was extremely short, I remember. For all the publicity I had expected something of a few days (and significant crowdfunder). Hopefully Sal's legal team's arguments were watertight but Australia seems a bit mad for gender ideology at the moment.

highame · 21/08/2024 08:03

This has big implications for all of us. I assume, for either of them, there is an appeal route

Fenlandia · 21/08/2024 08:52

This will be midnight on Thursday UK time - I won't sleep well if she loses.

ThoseWhoFindThemselvesRidiculousSitDownNextToMe · 21/08/2024 09:50

Keeping everything tightly crossed for sense.

Ignore this, I can't count. Sigh.

RoyalCorgi · 21/08/2024 10:10

I don't know enough about the law in Australia to assess her chances. The fact that she's morally right doesn't necessarily mean that she's legally right. If she loses, it will be devastating for Australian women and girls - but we can hope that if that's the case, it might spur campaigners into action.

Datun · 21/08/2024 10:37

Placemarking - with crossed fingers

BoreOfWhabylon · 21/08/2024 11:52

Sal seems prepared for further action if necessary

"These are the possible outcomes: Giggle wins, other side appeals or doesn’t. It’s a 28 day window to appeal. Giggle loses, we definitely appeal. First appeal is to the full bench of the federal court. It’s a one day hearing. If that is a loss, it’s High Court time."

Fingers crossed here, too. Good to see Sal is prepared for further action if necessary .

ArabellaScott · 21/08/2024 12:19

Good luck, Sal.

HoneyButterPopcorn · 21/08/2024 12:25

Fingers crossed for Sal. How people can have such a brass neck I'll never know. Whats gone wrong with Australia?

TheSandgroper · 21/08/2024 12:41

She has previously said that if she has to take it further, she will be in need of another $500k.

Igmum · 21/08/2024 12:44

Good luck Sal. I really want her to win, but very much fear that she won't.

I’m afraid I also very much fear she won’t win because the judge will have to follow the law as it currently stands. I fully anticipate that the decision, however it falls, will be appealed to the Full Federal Court and then if necessary the High Court. Sall seems committed to the long haul. I have enormous respect for her.

I desperately want her to win - but given the capture within Australia, especially within government and regulators, I just don’t think she will succeed.

I know Sall is ready for further fighting, and I greatly admire her commitment to pursuing this further if the case is lost.

There has been a subtle change in Australia very recently - since the Olympics and The Cass Review, really. It will be interesting to see if that shift towards science and reality is reflected in any reporting of this case.

The mainstream media wouldn’t even talk to Sall, let alone do a supportive piece, so we will have to see…

FriedGold32 · 21/08/2024 15:35

Sadly I don't expect Sall to win, Australia seem to have gone loopy for this stuff.

Possibly not at this stage, much more likely at the Supreme Court. But lets not put bad juju in the airways nonetheless.

Villagetoraiseachild · 21/08/2024 18:48

Sall, if you get to read this we absolutely support you, however far it needs to go.

Tallisker · 21/08/2024 19:44

I can't bear the suspense 😬

Snowypeaks · 21/08/2024 21:36

I think Sall will most likely lose at this stage.

But it might be the best thing if she has to take it all the way. Strictly speaking, case law is against her - from what I can tell as a non-lawyer thousands of miles away - so if she wins now it will probably be a fudge, or the judgement will be narrowly restricted to the specific facts of the case. If she goes to the highest level, and wins there, which she ought to, then a binding precedent is set as to the primacy of sex over GI in the Sex Discrimination Act. I think Sally also said at some point that the Gillard amendment to the Sex Discrimination Act (which removed the definition of "woman" and added GI) itself could be ruled unconstitutional if she wins at that level.

It's going to be hard to get to sleep tonight!
