I’ve only speed read the judgement, but the judge does seem particularly scathing of AB, saying AB changed AB’s name to one that sounded masculine, and in an organisation that publicly claimed they didn’t employ men, it is not credible that AB didn’t expect that enquiries from service users would arise due to the name change. Plus the judge said AB’s reaction to Roz’s email was “overblown”. There’s other bits too, but the judges comments do all align with the discussion here at the time which says if you work at a Rape Counselling centre you need to be a bit more robust and also centre the service users, not yourself.

RocketPanda · 20/05/2024 09:11

Well done Roz, not just a win for you but for all survivors of rape and sexual assault.

I'm quoting this from the Times article (it was in the Scotland section of the online edition)

Sandy Brindley, chief executive of Rape Crisis Scotland, said: “An independent review into the practices and procedures at Edinburgh Rape Crisis Centre has been commissioned. We are also working with Rape Crisis England and Wales on a planned review and refresh of the national service standards.”

I'll be interested in the outcomes of both reviews.

Well, quite. Given how captured the sector is, I don't have confidence that they will be able to look at this objectively.

The case was made brilliantly in court by Roz's barrister Naomi Cunningham, also. TRAs tend to sneer at her, I imagine this will wipe the smile off their faces.

I’d want Naomi on my side in any dispute. She also represented Rachel Meade in her win against Westminster Council.
In Adams vs ERCC, I loved her line of questioning that led to a Spanish witness revealing that there is a male and a female version of the Spanish word for non-binary!

lcakethereforeIam · 20/05/2024 09:13

Thing is, I bet AB was giving MW exactly what he (genetically and legally male MN) wanted.

can we hope the BBC reports on it?

lol

Rainbowshit · 20/05/2024 09:18

Is there likely to be any repercussions for Wadhwa?

LarkLane · 20/05/2024 09:21

Fantastic to come to the Board here and see this judgement.

"Courage calls to courage, and its voice cannot be denied.'

WandsOut · 20/05/2024 09:21

Well I posted about this in AIBU and it was removed. MN HQ mmm worried about MW being misgendered than informing women of what has happened in an important rape service horror.

The title was "AIBU to think the CEO of Edinburgh Rape Crisis should be sacked."

I didn't call a man a man.
But no one should be calling this chancer a woman. No one.

I heard he was clinging on. ERC is certainly not doing any sort of mea culpa on social media. Tweets protected and some statement about how they still exist on insta.
but i don't see how he can continue in his role. i suppose his stated policy of firing dissenters and the fact that he had an army of dogmatic witnesses attempt to bail him out in the tribunal means he may have a loyal workforce. but can that possibly override this absolute stinger of a judgment?

I loved the judge's response to AB's characterisation of Roz's emails as damaging and humiliating, which I think could be paraphrased as 'Oh FFS no they weren't', or as the judge more judge-ishly put it:
'We entirely agreed with the claimant’s representative that for AB and MW to
later characterise the emails sent by the claimant as humiliating or transphobic
is a nonsense.'
The judge also said that AB's distress seemed to kick in only after discussing the emails with MW.

Lentilweaver · 20/05/2024 09:27

Great outcome! As an Asian woman, may I also register my utter disgust at Mridul Wadhwa using his ethnicity to claim his opponents are bigots. Stop it, you entitled knob. Even us Asian women don;t want a man in charge of a rape centre.

Snowypeaks · 20/05/2024 09:32

Naomi Cunningham is a brilliant barrister. Her questions are like stilettos to the heart.

ANewCreation · 20/05/2024 09:37

Any chance ERCC could appeal?

BillyBobbs · 20/05/2024 09:37

If anyone has edit rights to wikipedia pages or even can just go say somethign on the talk pages of either of these pages, please do, it's the first thing on google that people get

https://en.wikipedia.org/wiki/Mridul_Wadhwa

Ereshkigalangcleg · 20/05/2024 09:38

They could if they can find a legal point to appeal on, but whether it would be a good idea for them to do so is another matter.

theDudesmummy · 20/05/2024 07:44

Judgement totally ignored by the Guardian, despite them having previously covered the case. How is that acceptable journalism?

I don't think journalism is the Guardian's thing nowadays.

WickedSerious · 20/05/2024 09:43

PronounssheRa · 20/05/2024 08:23

I've just looked at the BBC website, obviously the main headlines are about the helicopter crash in Iran and the infected blood scandal.

But the local pages we have gems such as '50 year old crisp packet found' and 'Rescue team plans extension after outgrowing base' and 'Obese cat loses more than half her bodyweight'

A fifty year old crisp packet?

That's right up there with the time a murder was kept off the front page of our local rag by the scandal of parking charges being introduced in the town centre.

BoudiccaOfSuburbia · 20/05/2024 09:45

@MNHQ Why have you hidden the other thread about this? The one in AIBU that had a share token for The Times article in the first post?

This issue is about services for Rape Victims. It is important for ALL women to know, not just those engaged in the Gender Ideaology issue.

Why does a really important decision that affects women who are sexual assault survivors have to be kept only to this board?

Tbere are numerous bloody threads about the same topic where it involves Harry and Meghan. 🙄

BoudiccaOfSuburbia · 20/05/2024 09:47

This is what I tried to post on the now removed thread:
Well done Roz Adams. This must have been a dreadful ordeal for her.

The whole of the ERCC , Board and Management, who promoted and allowed this shit should be held to account, not only Wadhwa. Wadhwa’s role as a leading figure in the treatment of RA needs to be laid bare including the appalling statements made at other events , but Wadhwa didn’t act alone and shouldn’t take all the bad publicity just for being Trans. Iyswim.

A Board was responsible for the policy which enabled a Trans Woman to be appointed to such a role. A Board was responsible for making such an appointment. The powers that be in Scotland fuelled an environment that made this possible. Shame on all of them.

And they are idiots. Trans people need support against sexual assault the same as others and their needs shouldn’t be made into a political weapon.

May every victim and survivor of Scotland now get the help they need, whatever their sex or gender identity.

The well deserved praise reminded me of this article I saw a little while ago

https://www.thetimes.co.uk/article/naomi-cunningham-on-her-career-and-winning-a-gender-critical-case-l6th5g09w

https://archive.ph/uaQrI paywall bypass

Agree with both her final comments, although hasn't Goldacre totally bottled it re. genderwoo?

This bit made me laugh (for obvious reasons)

"What were the biggest hurdles you had to overcome in this case?
The original bundle — not prepared by my solicitors — was a repetitive, disorganised nightmare. I ended up spending hours organising it."

RedToothBrush · 20/05/2024 09:48

If someone who hounds gender critical people out of a job can be termed an extremist, whether does that leave Prevent and where does that leave political parties which do this?
