Employment Tribunal starts next Monday, not sure if it is available for remote viewing.

I have sent a request so we will see.

I hope your surgery goes well, @RocketPanda, and that you'll be well enough then to enjoy Ben Cooper wiping the floor with the OU's many witnesses.

Besides a possible strategy of thinking 18 witnesses will greatly assist in obliterating Jo Phoenix's funds, it strikes me that they might also be thinking they'll have a stronger case with Uncle Tom Cobbley and all on the stand. All those witnesses! Wow, how persuasive they'll all be! But only if they're any good. If they're rubbish they'll be a massive handicap to the OU's case. Fingers crossed 🤞.

Yes there may well be some laugh out loud moments when Ben Cooper gets going on the Open University's unflagging loyalty to Stonewall WEI, and to its own EDI policies and networks, and how those and its behaviour towards Prof Jo P are compatible with, you know, the actual law.

I would love for all 18 witnesses to be examined on this.

Thanks @ickky , they will be taking a tumour out of my brain so I'm going to be pretty out of it for a few days, although if I come back here a raging TRA they operated on the wrong part 😆

Eighteen witnesses? What a shambles that promises to be.
I can't think I've ever seen an Employment Tribunal with so many witnesses in all my years. Going for quantity rather than quality of testimony then, in a foolish attempt to intimidate?

The general rule I apply in my cases is to get one witness to support each point you need. Avoid overlapping as much as possible as that just increases the chances of contradiction and getting in a right old mess. If you need to prove that x said y, get one credible person to support it, tick the box and move on to the next point. 18 witnesses has the potential to be an absolute shambles, as well as a colossal waste of court time.

But not our time … or Ben Cooper’s? I imagine it is going to be very entertaining.

on a serious note, would it be expected of a solicitor or barrister to take note of the opposing barristers experience and track record, and then consider the risks of one’s witness list, and advise the client.
