This shows the arrest of a teenage autistic girl by about 5 police officers. From what I can make out it is for a 'hate' crime. She apparently said a police officer was a Lesbian. Her Nan is a lesbian - that police officer is like my Nan.

I cannot comprehend the mindset of these officers.

The Police woman was just spoiling for a fight, clenching her fists. She had a gleeful expression on her face.

I'm just repeating what everyone else has said here, but she's completely unfit to be a copper. She's nasty, power crazed and vindictive, everything she said and did was entirely unnecessary, not to mention her total disregard for the young girl's disabilities.

That poor girl just needed to be left alone. What's going to happen in future, if she really needs the Police?

De-escalate? She deliberately escalated the situation. One of her colleagues should have called a halt to things.

If, as has been mooted here, there was no viable public order offence and she actually assaulted the mother, there should definitely be a misconduct hearing. I suppose it all depends on how good the witnesses are.

The girl is reported to have been in the house when she made the comment, so I can't see how it was ever a public order matter, also not sure what right the police had to enter the house, I'm pretty sure that their entry was illegal.

The mob mentality of the other officers is also disturbing. Not one, not even one, stopped to ask “What the ever-loving fuck are we doing here? She said you…looked like her lesbian Nan?” (I’m mighty fine, might I add. She could do worse.) Even if they didn’t know upon arrival, they should have assessed the situation and used some common sense.

Remember, we don't know what she said when she called for backup. I'd say that, from the fact that none of them questioned it, it's reasonably likely they didn't exactly get an accurate picture.

Pretty sure, yes - certainly the arrest would be unlawful, because she had no consent or warrant to cross the threshold for the purposes of arrest. It would also be unlawful if found that there couldn't possibly have been a public order offence since both the officer and the girl were within "the dwelling" (which includes the garden).

That's why their mealy-mouthed "we have decided not to take further action" is such bullshit - I'm fairly sure that when they asked the CPS for advice (as mentioned in their original statement), they got an almighty smack around the head for not even understanding the basics of the very first section of the law they were trying to use. Even worse, that goes right to the top of WYP - it was their Assistant Chief Constable who made the statement which contained actual misunderstandings of the law!

I'm a bit unclear on this also.

I believe the officer was outside the house (by the front door) when the comment was made.

The fact she was outside was alleged grounds for public order, even though the girl was inside.

That said, I'm not clear in that case about BPO then entering the house without a warrant or not reading the child her rights prior to arrest.

Flip side if BPO was inside the house when the comment was made, that can't be a public order offence?

Given the level of response I really wonder what the hell the BPO said when asking for assistance.
