Times article I've just seen...

www.thetimes.co.uk/article/tavistock-gender-clinic-to-be-sued-by-1-000-families-lbsw6k8zd

I'm afraid I don't have access but the headline alone...

I'm assuming it's for overly enthusiastic affirmative care and not the opposite?

Yes, that's what the article says. Bloody hell, how much is that going to cost the NHS?? Stonewall should be forced to pay part... 🙄

WarriorN · 11/08/2022 06:37

Does anyone happen to have a share token please?

Text:

The Tavistock gender clinic is facing mass legal action from youngsters who claim they were rushed into taking life-altering puberty blockers.

Lawyers expect about 1,000 families to join a medical negligence lawsuit alleging vulnerable children have been misdiagnosed and placed on a damaging medical pathway.

They are accusing the gender identity development service [GIDS] at the Tavistock and Portman NHS Trust of multiple failures in its duty of care.

This includes allegations it recklessly prescribed puberty blockers with harmful side effects and adopted an “unquestioning, affirmative approach” to children identifying as transgender.

This could have been predicted at the point when Kiera Bell brought her case against the Tavistock. So many people pointing out the inappropriate ways that young people have treated by some of the clinicians there.
I hope they get justice for the horrors they have gone through - and I hope Mermaids is also identified as being harmful in the way they encouraged parents and clinicians at Tavistock to push the affirmation only model.

There has been far too much lying to children happening. It’s time we stood up and told them ‘no, you can’t change your biology’ despite what random people on TicTok tell you.

WarriorN · 11/08/2022 06:41

Thank you so much arctic.

Bloody hell.

Mermaids next.

Mermaids statement, guess what, they don’t agree. What schools in their right mind would rely on Mermaids vs the Attorney General esp post Allison’s case. mermaidsuk.org.uk/news/trans-rights-in-schools-mermaids-statement/

TidyDancer · 11/08/2022 06:54

Wow isn't this interesting! Not surprising at all when you consider the way the tide has been turning (thankfully). Good news day indeed! Just desperately sad that it's come at the expense of the health of so many young people.

Agree mermaids should be next. Still not sure why anyone had any faith in that organisation when you consider the founder and their motivations with their own child.

NecessaryScene · 11/08/2022 06:54

I'd be wary about putting too much stock in that flashy "1,000" number in the headline. This article is the lawyers touting for that business, so who knows how many participants they'll actually get, or already have.

But the important point is that someone has stepped up to start gathering the participants. A straightforward path is now open for anyone unhappy with their treatment, so we can expect a significant number.

FannyCann · 11/08/2022 06:56

It was only a matter of time
Can they go after mermaids or in some way add them in as well? It's probably easier to go straight for the NHS trust and that makes sense but mermaids have been hugely influenced in a malignant way, coaching children and parents in their demands and pressurising demands for medical treatment.
It's time mermaids were investigated, had charitable status removed and ideally were sued.

FannyCann · 11/08/2022 06:58

*influential not influenced

persons who share a relevant protected characteristic
There are 2 or more others which are ignored.

So
Single sex services

By sex

Sport

By sex

Uniforms
Either sex choose

Pronouns
(Hint its a school teaching english)

By sex

There is a right to ask but not demand other PC are ignored to favour one PC.

And I agree @NecessaryScene its all speculation until the court date is booked.

DirtyDuchess · 11/08/2022 07:10

And so it begins....and breathe!

Thanks for pointing that out NecessaryScene. Still, a good start.

It is written in a rather cagey manner and I'd also say they haven't got the full 1000 yet but no doubt they will do so.

I'm wondering about the possible knock-on effect of this in the US where damages awarded can be so much higher than here in the UK. Surely it'll scare the pants off some surgeons?

SolasAnla · 11/08/2022 07:17

@FannyCann that would be a difficult case to prove

The NHS are obliged to keep records and manage pratice and policy, to be experts in what they do.
Mermaids would pull a Stonewall, they are a group of parents providing information and advice parents are free to not act on it ......

FOJN · 11/08/2022 07:17

I agree and I hate it when newspapers publish those type of headlines. It will be interesting to see how many former Tavistock patients join the "class action".

SpinningTheSeedsOfLove · 11/08/2022 07:20

I think it has been on the cards a while that a ‘class action’ (group litigation) would arise out of Keira Bell’s case. The Court of Appeal, even while altering the judgement in her judicial review, pretty much acknowledged this (I thought).

And now the Cass Review is the springboard.

I hope that the real prospect of litigation gives captured schools pause for thought about their actual safeguarding duties and their liabilities.

Appalonia · 11/08/2022 07:21

Wow, I can't believe so many things we've longed for are finally happening! This will hopefully have a massive knock on effect on things like Mermaids and what is happening in places like America, Canada and Australia.

gogohmm · 11/08/2022 07:27

Unfortunately this is a case of you can't win. Just 2 years ago families were complaining they couldn't get puberty blockers soon enough to stop their kids developing male characteristics eg Adam's apple and deeper voices. Parents pushed for earlier treatment, I've met parents who bought drugs over the internet because the Tavistocks waiting list was too long!

How many of the people listed are actually just hoping for a payment nobody knows!

The reality is that gender services beyond counselling should not be allowed before 18 but parents have enabled their youngsters younger and more confused

WarriorN · 11/08/2022 07:31

That is true but I was just thinking of the world wide impact this case, if goes through, and indeed if won, will have. This will have a ripple effect. It's sends a signal to the us. Anderson has been preparing for this and already jumped ship. Bowers has a little too.

There's a possibility they won't win though I imagine it will be proven how much they bowed to mermaids.

Really it's mermaids who is on trial here.

Anyone else waiting to hear how this is a good thing actually from the monitors?

NecessaryScene · 11/08/2022 07:35

The Court of Appeal, even while altering the judgement in her judicial review, pretty much acknowledged this (I thought).

Very much so. They basically said that this is outside the scope of a judicial review - the law shouldn't up-front get in the way of doctors using their professional judgement. But a court could certainly rule on a doctor causing harm after it had happened, so whatever the doctors did would be on their heads.
