Woo hoo. This is really important. It makes a lot of the tools the the Genderists have been using to stop people from speaking out unlawful.

If won't stop the intimidation completely but it will give a lot of organisations pause and it gives women who have been wronged a clear path to redress.

Maya: your courage calls to women everywhere. I can't imagine how hard this was for you but you did it!

286.1 At pages 921 and 1034, where Ms Fortstater asserted that “other
people are not compelled to accept it [the proposition that a
transwoman is a woman] as relating to any material reality” and that
“ a man’s internal feeling that he is a woman has no basis in material
reality”. The Tribunal considered it to be clear that individuals might
be offended by these statements. They are, however,
straightforward statements of Ms Forstater’s (protected) gender
critical belief. The Tribunal considered that to characterise these as
manifestations of the belief to which objection could reasonably be
taken would be to hold that the belief itself was not worthy of
protection, when the Employment Appeal Tribunal has decided that
this is not the case.
286.2 At pages 915 and 932, where Ms Forstater drew a comparison
between transwomen and Rachel Dolezal. The Tribunal did not
consider it necessary or appropriate to embark on any analysis of
Rachel Dolezal’s situation. We found, however, that the point that
Ms Forstater was making – that there is an analogy to be drawn
between someone who is white identifying as black and someone
who is (according to gender critical belief) male identifying as a
woman – did little more than assert her gender critical belief.

It'll take me a while to read the full judgement, but even on the aspects where she didn't win, there are a lot of useful words and, frankly, pointers, about where future cases might go (that also overlap with Allison's case) especially where research needs to be carried out.

This is very useful indeed. Absolute gold-dust meets dynamite.

I presume that part of Maya's strategy in this case (and I am not saying this as any sort of criticim, I presume it is normal) is the "throw as much shit at the wall as you can and see what sticks" approach.

It seems to me that any claim that Gender Critical beliefs are more likely to be held by women was always a long shot. Women might have thought about their belief and might be more likely to hold a considered, thoughtful position... but I'd imagine that if you were to judge the belief by asking a load of straight men and women whether they really believe that TWAW and TMAM and whether they are open to engaging in "straight sex" with trans people of the same biological sex as them then men would come out as more GC than women. Less missplaced "be nice" going on.
