Is anyone live following the Judicial Review brought by Fair Play for Women regarding the recording of sex in the 2022 Scottish Consensus?

I'm assuming it's allowed to be discussed as FPFW have been allowed to live tweet it.

OP posts:

I'm not on twitter so can't but have been waiting with fingers crossed especially after the BBC had that moron on this morning claiming that there's no agreed definition of sexConfused

Signalbox · 02/02/2022 11:17

Sounds like the judge might have had Stonewall training...

Signalbox · 02/02/2022 11:19

Stonewashed.

I thought that too. There is no looking at sex "with modern eyes"

Shock

Hoardasurass

I'm not on Twitter either but if you click the link and select "open in incongnito tab" or c+p the link into "new incognito tab" you should be able to read it.

'Lord Sandison graduated from the University of Aberdeen in 1989 with an LL.B Honours degree before gaining a Diploma in Legal Practice from Edinburgh University and a Diploma in Forensic Medicine from Glasgow University in 1990.

He then went on to gain a Masters Degree in 1991 and a Ph.D. in 1994 at the University of Cambridge before joining Brodies as a Bar Trainee. He was admitted to the Faculty of Advocates in 1996, and was appointed as a Queen’s Counsel in 2009.'

'Sandison acted for Wings Over Scotland blogger Stuart Campbell '

Thanks @FOJN

Rodedooda · 02/02/2022 11:31

Very canny, stonewashing the judiciary.

I'm so pleased that FPFW is taking this forward, but nervous of the outcome.

Artichokeleaves · 02/02/2022 11:32

Yeah this one's going to be an action replay of the other one, where it took going to appeal as the judge had been Stonewashed. And the findings about the judge's work at that appeal were quite interesting.

Rodedooda · 02/02/2022 11:36

Was it too much to hope that the Nolan report would've made a difference by now?

Signalbox · 02/02/2022 11:48

FFS judge has fallen down the rabbit hole for certain...

I mean what the fuck is "lived sex"?

ArabellaScott · 02/02/2022 12:04

@Signalbox

My advise is not to google it, anyway.
littlbrowndog · 02/02/2022 12:05

Waiting in this. Git the tummy nerves about it

littlbrowndog · 02/02/2022 12:05

Got not git ffs

Whatsnewpussyhat · 02/02/2022 12:12

Sounds like the judge has already decided that the female sex is irrelevant.

InvisibleDragon · 02/02/2022 12:21

I'm confused - how can the outcome of this review be different from the one for the England and Wales census last year? Is it really as subjective as the opinion of one individual judge?

titchy · 02/02/2022 12:27

Surely the definition they use has to take account of the purpose of the data? Which amongst other things is to inform and anticipate the health needs of the population. If there's a decline in the number of middle aged males then it would be reasonable to assume that would lead to a decline in the need for prostate screening so those services would be reduced. Which probably wouldn't be what TRAs wanted...

Lovelyricepudding · 02/02/2022 12:28

If legal sex was livedoing sex then what does that mean? Why would there be an issue over same sex marriage? Or that attempted 'gotcha' court case (Forbes? ) about inheritance? How would you record sex on a birth certificate?

drwitch · 02/02/2022 12:28

Here's the answer I think

Lovelyricepudding · 02/02/2022 12:29

The Equality Act is clear what sex means and it is not some vague concept of lived sex.

Lovelyricepudding · 02/02/2022 12:36

Ross QC says "What is your sex" as meaning what's on your birth certificate or GRC is not the most 'natural' meaning of the words./35

I agree with this - there is nothing natural about the GRC
