"In April, the LGB Alliance was made a charity after the commission decided the group benefitted the public through its educational and awareness-raising activities about discrimination based on sexual orientation."

"On Tuesday, transgender children’s charity Mermaids launched an appeal against the decision at the first tier tribunal, supported by other charities and groups including Stonewall, Gendered Intelligence, and the Good Law Project."

Good point Winter. it's got to be just a matter of time before we're crowdfunding cases against social media platforms. the online harms bill this year could make a difference if enough people feedback

LGBA could now sue twatter for harassment after the Maya case Grin

@highame

LGBA could now sue twatter for harassment after the Maya case Grin
now THAT would be a case!

Agree Brown. No-one should be bullied and told they’re transphobic for simply stating which sex they're attracted to. The HER app was kicking off lesbians for saying 'I'm attracted to the female sex only'. REDDIT kicked off lesbians and have lesbian subreddits run by male heterosexuals.

@yourhairiswinterfire

LGBA got a blue tick on Twitter, then got it taken away again after mass complaints.

What does the achieve, exactly? I think it's pretty fucking tragic that this kind of targeted harassment is what it takes to make some people feel good about themselves 🤷‍♀️

I just spotted that. Twitter aren't even pretending to be a neutral platform on anything.

Surely the blue tick system was originally devised to provide verification of legitimate organisations and high profile individuals to prevent fraudulent accounts?

Is a blue tick now just a reward to be given or taken away based on current orthodoxy by people with too much time on their hands?

Looks like it. Something needs to be done about this. These organisations have too much power which impacts massively on democracy, and the laws of individual countries. I think the tide will start to turn on this one next.

EmbarrassingAdmissions · 10/06/2021 15:22

I think the point is a bit subtler than Peter Daly makes it out to be

I wonder if Peter Daly is writing for an audience that is not clued up on this, unlike the denizens of FWR?

FindTheTruth · 10/06/2021 15:24

probably Embarrasing. It's linkedin. good that it's getting air time where HR people hangout

I wonder if any action can be taken against social media platforms for how appallingly they've treated women? Like a class action lawsuit or something?

I know they're allowed to set their own terms, but ffs, a woman was just suspended (or maybe even banned) from Twatter for saying that men are stronger than women. Another was banned for correctly stating the law during the FPFW v ONS case, and lesbians are being booted off platforms for being same sex attracted Hmm

They're discriminating against women, and they also allow the targeted harassment of women. TERFs is currently trending, lots of woman hatred on display, jack shit will be done about it.

So sick of it, lets hope something can be done.

FindTheTruth · 10/06/2021 15:47

Agree Winter. The discrimination of women by these platforms is appalling. If a case can be made, given that these platforms are foreign, (INAL) support on 'women's rights island' will be huge

"the [Maya] judgment is also likely to be of significance in wider attempts to silence gender–critical organisations such as the LGB Alliance, who currently face a concerted group action of trans/LGBT charities arguing their beliefs are not worthy of respect."

I'd forgotten about this appeal.
Just had a look on the Crowdfunder page and the most recent update says:
-

The Tribunal has set out next steps

Two weeks ago, we supported Mermaids in launching a challenge to the Charity Commission’s decision to grant LGB Alliance charitable status. The First Tier Tribunal has now set out deadlines for the next stage of the appeal.

By 13 July, the Commission must produce a response explaining its decision to register LGB Alliance. It also has to provide copies of any documents which it relied on in reaching its decision, and any other documents which might support Mermaids’ case. Our legal team will review that material carefully and, if possible, will use it to bolster the appeal.

There will then be a case management hearing in early September, at which the Tribunal will decide how to progress the appeal to a final hearing.

For now, we await the Commission’s response – we will keep you posted.

Thank you for your support.

@bitheby

I remember when I used to go to gay bars in the 2000s. The gay men used to take up most of the space and were served first at the bar; in fact nobody else got much of a look in with the male bar staff. The lesbians hung out in small groups in the back room by the pool tables. The cross dressers (as they were then) were in a smaller group in the back room near the lesbians. We were all in jeans and T-shirts and they were in heels, fishnets and tiny leather skirts.

I didn't see much evidence of anyone supporting anyone really. It was all very siloed. Plus ca change.

The couple of times I went to gay pubs with friends back in the 70's/80's were EXACTLY like that. My friend was gay and I stuck out like a sore thumb in that sea of denim and leather. There were a few butch lesbians who I'm pretty sure sized me up as not gay or bi and didn't hit on me. Or maybe they just thought I was a munter. Thank you for bringing back those memories!
dyslek · 06/07/2021 19:57

The gay put I went to a couple of times in the 80s was a pritty friendly place tbh. They were always alright to us, we were all about 14 tho.

RedDogsBeg · 06/07/2021 20:16

What are Mermaids and Gendered Intelligence so afraid of that they want to stop a charity that stands exclusively for LGB?

Signalbox · 30/10/2021 19:51

Looks like this action is going ahead and LGB Alliance now have a fund up and running…

Signalbox · 30/10/2021 19:53

“LGB Alliance is one of a dwindling number of organisations across the world that focuses exclusively on the rights of LGB people. We believe we are now the only group in the UK that defends and promotes the interests of LGB people as defined in the Equality Act (2010) – that is, on the basis of biological sex. Yet we’ve faced many threats from the day we were formed. Lies have been told, false stories circulated, and petitions have been organised against us. Our Crowdfunders were taken down, and boycotts mounted of anyone who dared to show support. The tone of claims about us has been angry and sometimes vicious. We’ve just got on with the job we were set up to do, which is to defend and promote the interests and rights of lesbians, gays and bisexuals.

Now Mermaids is challenging the Charity Commission’s decision to award us charity status. We’re determined to defend what was an important breakthrough.

We are therefore raising funds to pay the necessary legal fees. If Mermaids succeeds, we will have our charitable status cancelled and will no longer be able to do our job as effectively as we would like to.

The substance of our case is primarily that Mermaids has no standing on which to bring this case. See s.319(2)(b) Charities Act 2011, which points to Schedule 6 Column 2 of the Act. These say that the only people who can bring such litigation are the Attorney General, the trustees of LGB Alliance, LGB Alliance itself, or “any other person who is or may be affected by the decision”.

Mermaids say they are “any other person who is or may be affected by the decision”. Both we and the Charity Commission have set out why Mermaids’ pleaded case is simply wrong and they don’t have standing.

There is a clear precedent in Nicholson v the Charity Commission for England and Wales [2016] UKUT 198 (TCC). The ruling stated that a person has no standing to bring an appeal of this nature even if they “disagree[s] with the decision [to register a charity] emotionally, politically or intellectually and as a result is affected emotionally and/or socially”. This perfectly describes and therefore excludes Mermaids from bringing its case. Mermaids’ case should therefore, we say, be thrown out.

Secondarily, even if the tribunal rules that they do have standing, their case has no merit. The substance of Mermaids’ appeal is that they disagree with our views on sex and gender. We take what has become known as a “gender-critical” approach to these matters: that sex in humans is biological and immutable. Mermaids say that this is wrong, and any charity that is founded on these principles is unworthy of registration as a charity.

Our lawyers are Peter Daly and a team at Doyle Clayton, and Alice de Coverley at 3 Paper Buildings. Their work up to now has been fantastic but we did not want to be in this litigation.

We are now at a stage where we need to raise money to complete the litigation. We are the underdog in this battle.

Mermaids have a team of lawyers and a conglomerate of other organisations in the background. They have raised around £70,000 for this case so far. Our opponents are extremely well resourced.

In the first instance, we are seeking £5,000 as an initial target. This will help cover the costs we have incurred to date. If the matter proceeds, we will need to raise more. Any surplus will be reallocated to cases that defend LGB rights and the importance in law of biological sex.

This is a crucial case for us. If we lose our charity status it will be harder to raise funds for the important work we plan to do: such as offering assistance to young and vulnerable lesbians, pushing back against the erasure of LGB people across the world, and reviving LGB culture. It will also be a blow to the right of same-sex attracted people to lawfully organise and form a regulated charity. If we lose, people with same-sex sexual orientation will lose a fundamental legal right.

Please support us.

We will be very grateful for all your donations!”

PronounssheRa · 30/10/2021 19:54

Don't you just love it when a straight men tries to shut down an organisation for same sex attracted people.

Stealhsquirrelnutkin · 30/10/2021 20:19

Thanks for letting me know their crowdfunder had started. By the time I found the page and chipped in they had already hit the stretch target and donations had reached £21,220. Seems there is a lot of support out there for an organisation willing to protect the rights of same sex oriented people. Or maybe it's just that most decent people really despise bullies?

I hope those behind the legal challenge are firmly trounced, and that LGB alliance are awarded costs and compensation for the drain on their time and energy.

TrainedByDinosaurs · 30/10/2021 20:35

Thanks for flagging this, I’ve donated.

I wonder if it needs a new thread linking back to this one as I thought the matter was closed once the Charity Commission provided their explanation for why LGB Alliance was eligible for charity status so nearly missed that there was a new legal case

NoToast · 30/10/2021 21:01

I'm always surprised at the extent to which Mermaids as a children's charity feels it can dictate to the adult LGB community.

prudencepuffin · 30/10/2021 21:21

Just donated - if ever we need an organisation to stand up for the LGB community, its now.

Theeyeballsinthesky · 30/10/2021 21:25

Donated - this is utter bloody nonsense. Jolyon can get to fuck

StandUpStraight · 30/10/2021 21:38

Donated. Thank you for sharing. What a bunch of appalling bullies.

Can LGBA do a counter claim into why this Mermaids are using their charity funds to harass groups they don’t like?
