Can’t see how it can stand, given in the high court, judge said “Free speech includes the irritating, the contentious, the unwelcome and the provocative”. But here because the tweets cause “annoyance and anxiety”, they’re unlawful. It makes an absolute mockery of our courts, so they will have to reconciled on appeal, just hoping in the right way.

So disappointing but the Fair Cop judgment and the chance for Kate to appeal are positive. How long will an appeal take though and how much will it cost? Hopefully she can get crowdfunding again. It will certainly be taking its toll on her.

Totally: we simply have to fight this. I'm going to save up, ready for the inevitable next crowdfund. It's going to take many cases to win back what we've lost, never mind to strengthen our rights!

Just to make this clear.

Kate was banned from Twitter
Made a second account as we all do
She didn't contact claimant but claimant found her via photos of her dog, as admitted in court
Second account banned, 3rd account made and the same thing happened

The police recorded NONE of the claimants tweets so each and ever one of Kate's tweets have no context nor meaning

Each time said account was found claimant told her to delete account or it would be reported and amended to claim. Which they were.

The fact the claimant admitted in court that they knew about Kate, her husband, where they lived, their jobs, their children etc is apparently not harassment.

I hope in the appeal Kate is allowed to disclose the full extend of claimants criminal record.

It is not illegal to call anyone a racist otherwise all the tras and each and every member of the labour party would be in jail.

It's worth remembering the tactic that Hayden used. (How much time does e have?!!) The judgement shows (at least until we win the appeal) that we must be aware that people that are utterly unhinged and spending hours* cross-referencing our social media. But it's not harassment.

I made a passing joke here in August about looking for a solicitor who was allowed to practice and got a defamation note from admin saying I'd been reported by hayden under the defamation act and for my tweet to stand I would need to give my full name and address, which I did.

This is the tactic used by a certain "lawyer" and it's all out in the open for all to see.

Let's hope the next judge allows the full extent of their criminal record to be read out in open court.

Someone needs to write a clear letter to the major papers about this, explaining in clear terms what happened. And defending Free Speech.

This from Pinknews, paints a very different picture.

'Scottow used two Twitter accounts to “harass, defame, and publish derogatory and defamatory tweets”, according to the paper.
... the police arrest, in fact, stemmed from Scottow allegedly sharing “confidential details of my personal medical and financial information” on social media.'

Appeal from a magistrates court conviction is to a Crown Court, not a Judicial Review. Magistrates courts are not courts of record so the judgements are not recorded, only the decision and sentence.
As a man I find this whole business absolutely appalling.

I was in court this morning. One of the many gobsmacking things the judge said was that it didn't matter that Kate's tweets weren't directed at Hayden - she said the internet was open and therefore anything posted could be seen by anyone. (That wasn't the exact wording, but the gist.)

The verdict was just unbelievable, really. Absolutely no recognition of Hayden's lengthy criminal record or history of litigation to silence people. Telling Kate she should be "kind". Just unbelievable.

The only consolation is that, with all the attention trans issues and freedom of speech issues are getting this week, there will probably be a lot of comment at the weekend about this and Harry's case.

Presumably every woman who has been harassed, subject to rape threats, vile language etc on Twitter can now expect her harasser to be found guilty in court.

Wouldn't it be good if they all compiled the legal evidence and made a complaint in the same week?

Anyone here?
