Excerpts:

The case cleaves opinion in two: either it is discriminatory of the beauticians to refuse to wax a trans woman's genitals regardless of what they look like, or it is discriminatory to force a woman to handle male genitals against her will.

Fiona Robertson, the SNP's National Women's and Equalities Convener, says Ms Yaniv is a female predator and that women predators often use their womanliness to gain access to victims.

To avoid Yaniv-style legal cases, the Scottish Government must be explicit in how the Equality Act will apply to any new law.

Wouldn't it be useful, instead of sloganeering and calling women c, for politicians and charities to give explicit, detailed answers to questions being asked? The only way to allay fears is to tackle them head-on.

Fiona Robertson? What a complete pile of shite, it’s embarrassing, she’s delusional.

JackyHolyoake · 26/07/2019 21:08

Fiona Robertson, the SNP's National Women's and Equalities Convener, should actually read the UK Equalities Act 2010

[What kind of representative of the people does not understand relevant existing law here? A representative who is a propagandist perhaps?]:

Schedule 3: Services and public functions: exceptions

Part 7: Separate, single and concessionary services, etc

Section 26: Separate services for the sexes

Section 27: Single sex services

Section 28: Gender reassignment

www.legislation.gov.uk/ukpga/2010/15/schedule/3

together with the Explanatory Notes

[paras 729 - 740:

JackyHolyoake · 26/07/2019 21:15

Fiona Robertson, the SNP's National Women's and Equalities Convener, should actually read the UK Equalities Act 2010

also needs to make herself aware of relevant UK case law, wherein it is determined that where no GRC is obtained any person must be treated as their natural sex [the legal comparator is the sex 'transitioned' from not the sex aspired to].

From 2003 [pre-GRA 2004]: www.casemine.com/judgement/uk/5b46f1fa2c94e0775e7ef4e3 [paras 70 onward]

and relied upon post-GRA 2004 in 2013: www.casemine.com/judgement/uk/5a8ff7bb60d03e7f57eb1a1f [paras 63 - 68]

JackyHolyoake · 26/07/2019 21:20

Fiona Robertson, the SNP's National Women's and Equalities Convener, should actually read the UK Equalities Act 2010

may also be unaware that sex is defined in UK case law as "a congruence between chromosomes, gonads and genitals"

www.pfc.org.uk/caselaw/Corbett%20v%20Corbett.pdf

or: swarb.co.uk/corbett-v-corbett-otherwise-ashley-fd-1-feb-1970/

Beyond this, UK Equality Act 2010 defines the sexes thus:

man is a male of any age
woman is a female of any age

section 212: www.legislation.gov.uk/ukpga/2010/15/section/212

The politicians going out on a limb about this may be hung out to dry if JY's cases fail and TRAs decide JY is not actually trans. Because of course no true trans person would demonstrate symptoms of mental illness, a menstruation fetish, a public toilet fetish, paedophilia and a desire to sexually assault women using a legal framework. With a side order of possible racism.

There is no link between female sexual predators and JY. The two topics are not connected.

JackyHolyoake · 26/07/2019 21:29

Informed by all this knowledge of UK law, I am at a loss as to how Ms Robertson can possibly refer to a Canadian male as a female predator in the context of the media imparting information in the UK.

Perhaps Ms Robertson would be better advised to await the outcome of this Human Rights Tribunal before making any comment at all? It is not even confirmed, within the context of Canadian law, that the person concerned is a female predator.

One suspects "Woke points" may need to be deducted from Ms Robertson's account!

GirlDownUnder · 27/07/2019 07:25

TRAs decide JY is not actually trans. JY has been renounced by lots already, judging by the responses to this tweet:

mobile.twitter.com/trustednerd/status/1154794779319791616

Today's media will not help in that regard either. Today is a very sunny day TennisTennis

ItsAllGoingToBeFine · 27/07/2019 13:19

if JY's cases fail and TRAs decide JY is not actually trans

TRAs can't decide that or the whole case for self-ID goes kaboom.

TRAs are fucked really.

Either Yaniv is trans in which case single-sex services need beefed up to protect from predatory transwomen

Or Yaniv is pretending to be trans in which case gatekeeping is necessary and self-ID is a dangerous idea.

Are we quite sure Yaniv isn't a feminist in deep cover?

Playing on the ignorance of English media who'll assume our national accent is for poor people.

It’s not just playing on the ignorance of Scottish accents. I grew up in Scotland and worked for a while in Glasgow, and Mhairi Black does have quite a thick Glasgow area accent. She does sound the part she’s playing. It would be interesting to hear her parents speak. It may be she’s deliberately camping it up.

Compare it to David Tennant, for example. Doubtless people with a finely tuned ear might be able to tell where he’s from, but to me it just sounds generically Scottish, which is similar to the way I speak.

LassOfFyvie · 27/07/2019 14:46

I think she's camping it up. David Tennant is a good example as is Gordon Brown, Ruth Davidson , Kezia Dugdale, Wendy and Douglas Alexander- all middle class Scottish- just like Black.

TriptychDebbie · 27/07/2019 15:03

This has just been uploaded by a Canadian journalist who was threatened by the Yanivs

InTheHeatofLisbon · 27/07/2019 15:07

I agree, it's very definitely working class Glasgow the way she speaks.

A choice perhaps?

I spend a LOT of time in the east end of Glasgow, I've lived in Lanarkshire for the last 25 years but my southside of Edinburgh accent is still clearly southside of Edinburgh (possibly the odd word doesn't) b

youllhavehadyourtea · 27/07/2019 15:12

MB...a touch of the Nigel Kennedy about the accent - Paisley style.

Such a catch 22 dilemma eh?

Datun · 27/07/2019 15:53

*
Or Yaniv is pretending to be trans in which case gatekeeping is necessary and self-ID is a dangerous idea.*

And if the latter, I'd like to see an evidenced based explanation of how exactly you gate keep to keep predatory men out.

Because that would be one hell of a tool to have for every woman on the planet.

TriptychDebbie · 27/07/2019 15:58

If we could bottle it we'd make a fortune @Datun

TurboTeddy · 27/07/2019 17:03

It's not just genital waxing. We should be scrutinising what's happening in Canada more closely, here's a twitter thread about the issues they're facing in prisons.

mobile.twitter.com/Mason134211f/status/1142203566314184704

There's also another case waiting to be heard by the BCHRT, brought by a trans prisoner claiming descrimination because a female guard refused to do a body search.

Self ID is not quite the success it's being sold as and I wonder how many more cases there are that we never get to hear about.

TriptychDebbie · 27/07/2019 17:38

This is Meghan Murphy talking to the lawyer representing 3 of the women that Yaniv is suing.

andyoldlabour · 27/07/2019 20:26

"TRAs can't decide that or the whole case for self-ID goes kaboom."

You have got it in one - brilliant, the house of cards is about to tumble - I hope.
I loved the speed at which JY got up from the mobility scooter in the Youtube video.
