This is a continuation of all that is JY and their waxing cases bought against minority women in Canada.

We are a fair way in, and still are no closer to knowing what the final judgment will be, but we have lots of info. and are finally seeing this case, and all the attending issues with self ID, in the public eye and main stream press.

That document is dated 30 May, so JY still has a few more days to pay. I don't know if the other respondents will be eligible to apply for costs if JY loses the other cases.

Good point OldCrone re the dates, be interesting to see if it is paid.

My reading of the $150 awarded to Laser Cut Beauty Salon, is that the BCHRT imposed it because they were pissed off with JY.

From reading the BCHRT website and how the tribunals work, no costs are awarded to the respondents in a 'lose' situation because there is not really a win / lose scenario. It's more the compliant is upheld or denied.

If the complaint is denied (JY 'loses') there is no $ loss to JY, as JY has not paid anything to take to tribunal and therefore there is no $ to award.
If the complaint is upheld (JY 'wins') then JY will be awarded $$$ based on whatever law was broken ie discrimination, and the respondents (the waxers) will be liable.

The $500k that JY is also pursuing because of alleged wrong doing by the lawyer will also have to be shared and paid by the women

It's really difficult to understand all this with the JY complaints because the HRT was set up more to protect the underdog for eg a wronged employee with no funds to take on a company that for eg wrongly dismissed them.
If said employee 'lost' the case and their complaint was not upheld, we could not really expect the employee to pay the company costs.

Sadly, Pumpkin, I think you're right - if there is a get out like that they can use I'm sure they will consider it to save face for even letting it get this far.

This really shows what an abuse of the system this case is. The HRT was designed to help people like the women in this case if they were unfairly discriminated against. Not for sexual predators to abuse them.

With the earlier ruling, though, it looks as though the court has the authority to make a vexatious claimant pay costs to the respondent under some circumstances.

Especially as I have read tweets by JY complaining that crowd funders have been set up for the women JYs abusing because JYs the actual victim dontcho know.

Interesting that the charming Haddock, in this instance, uses the full LGBTQ+ which ignores the fact that most people are concerned with the T, specifically the implications of self ID rather than trans people generally. He also fails to mention why the T are more than a "little tetchy" nearly all the time.

Thank you for the info on costs, that's interesting. I can see why they wouldn't want to discourage someone from taking a case to tribunal because of monetary concerns but at the same time it seems extremely open to abuse - $150 in costs is hardly a deterrent when JY is chasing many times more than that.

I'll be pleased if JY loses, no matter the grounds. I'm pretty sure that it's too much to ask for that the tribunal will affirm that sex exists so I'll just hope that they at least affirm that women can't be compelled to touch a stranger's penis in their own homes. Baby steps...

Can't remember where I saw it but someone senior in the company (CEO? ) has been made aware of this claim and reports that the salon JY is claiming to have closed has simply relocated and the decision was not in anyway connected to the case before the BCHRT.

I think JY may turn out to be illustrative, in the long run and on current form.

This really shows what an abuse of the system this case is.

But also how important it is to realise that any time you create a system without the means to safeguard itself, it can be twisted for malevolent ends.

We've had a tendency over the last while to act as if "vulnerable" groups don't need those kinds of safeguards in systems designed to help them. As if no person from a marginalised group would ever think of harming a system meant to help their group, wouldn't be capable of that kind of lack of respect.

But there are users and abusers in every population and they are always very good at seeing where they can get an advantage. And others will try and fit themselves in there as well if it affords an advantage.

But there are always people who will use whatever opportuities they can
