To note:

  1. At the end, you will be asked whether you are resident in Scotland, the rest of the UK, or elsewhere - i.e. you don't have to be in Scotland, though obviously it's more important to be heard if you are.
  2. You will also be asked whether you want your response published with your name, without your name, or not at all - if that makes a difference to how you write your answers, it might be helpful to know this up front. Closes on March 1st, but don't wait till then!

I'm filling this in now. Hilariously it asks whether I think the self-ID process should be available to everyone or just to Scots. I have written:

"What will it matter? People can just "identify" as Scottish and that'll be that. If people are allowed to legally 'change sex' on their own say-so, I hardly think a little matter of nationality trouble them."

My comments are getting more and more snarky as I go on. I think they're very silly questions...

I told them that making self-ID open to tourists would be a great way to turn Scotland into a favored holiday destination for predators. Hey, we may have shitty weather, but you can flash all the women you want in the changing room down at the swimming baths and it's perfectly legal!

Couple of points on all of this.

The Scottish government (SNP in effect for the past decade) have form for forcing through poor legislation. Only yesterday it was announced that tehy would be repealing an Act designed to tackle sectarianism in football. This was pushed through in 2011 on SNP votes only. Almost everyone else, whatever their political persuasion, agrees that it;s a dreadful piece of legislation which doesn't do the job it was intended to do.

Also, the SNP do not permit dissent in their ranks. SNP MPs at Westminster or MSPs in Holyrood are not allowed to vote against party policy. So you don't get the situation of "rebels" who vote on their conscience of go against the majority for whatever reason or abstain. They vote on masse.

The SNP don't have an overall majority, but do with the Green vote. The Green MSPs are right at the front of this whole self-identificaiton thing and will take pride in supporting the legilsation through.

I;ve seen these consulations before and have huge doubts that anyone in power ever looks at the results.

SNP are all about independence. They are very keen to do anything which shows Scotland as different, special, separate. Look at us, we're so progressive and liberal and tolerant and so differnet from these nasty Tories in London. Don't you want to live in a country where everyone is welcome and tolerated? Well that means we have to be independent.

Although the Tories appear to have quietly shelved their GRA, it was inevitable that if the change was hailed as progressive in Westminster, there would be a Bill in Holyrood as well. But - now the Westminster one may well be on ice, what happens here now? I know the standard rhetoric is that we're all progressive and will buy into this, but the fact a gender critical article got into the National (shortly followed by an 'everything will be fine and men already access women's spaces' Bella Caledonia article to remind people how progressive we are) does indicate that not everyone is on board. If the issue stays high up the agenda then we can expect more people to start writing articles on it and there may be an actual debate.

On the Wings thread he said that there were SNP politicians concerned about this behind the scenes. I was at a youth LGBT event at the Festival of Politics last year chaired by Christine Grahame and when someone mentioned toilet access she seemed genuinely surprised and not particularly in favour. I know there is the 'loyalty clause', and at the moment people aren't breaking rank, but Brexit has shown us that there are SNP figures who will disagree with the party (although not yet at the point of rebelling in votes).

The Scottish Bill may be close to a done deal, but the SNP have shown themselves able to respond to shifts in public opinion. Enough gender critical people filling in the consultation might give them an 'out' if they want to back-track or amend the proposed legislation. And although we don't have elections coming up here, if the SNP see UK parties suffering because of this issue, it might make them think.

It was the divorce question that made me see red. Sure, force people to stay married to people they don't want to be married to any more for longer than would otherwise be the case. I'm sure the fact that most of the people transitioning when married are men and therefore most of the people unable to get a quick divorce will be women is totally coincidental.

It's ludicrous - the thing that 'peak trans'd' me over all this was when I read an article stating that there would (of course) be exceptions to the legislation so that a woman / girl self ID'ing as male would And could not be considered male in order to inherit title or lands. That cleared up just who they're willing to throw under the bus on this one.

There was a question (paraphrasing) that asked whether a person should require spousal consent before applying/being issued with gender recognition cert.

I said no, spousal agreement shouldn’t be required. But it should be grounds for immediate divorce.
