I do feel the biggest hurdle between Harry and his family is that he lives in another country, I think if he lived in the UK there would be more opportunity for them to sort it out

Well yes, which means it is unlikely he will see his children regularly, if at all. He won't be allowed back there so it will be up to her to bring them to him either in the UK or elsewhere. Surely even the most virulent Sussex hater wouldn't wish that for currently 2 pre schooler that they don't know?

This is my post from a few weeks ago on the "5th Feb Court Case" thread about Harry's visa status. Thought I would copy it here, as the discussion has turned in that direction:

Honestly, I have always thought this to be correct; that Harry, if he is on an A1 visa, is in breach of it, because he is working for himself, and not for the UK government. I'm not so sure now though.

As I understand it, there are 2 things to consider, visa classification and visa status. Classification is A1, A2, tourist etc. Status is diplomatic or otherwise. The diplomatic status gives you certain privileges and immunities, eg immunity from prosecution.

I had a look at the section 41.26 of the Code of Federal Regulations on diplomatic visa status. Assuming Harry holds a diplomatic passport (I'd have thought that was a given because of who he is) then he is eligible for a diplomatic visa regardless of his visa classification:

Classes of aliens eligible to receive diplomatic visas. A nonimmigrant alien who presents a diplomatic passport or its equivalent shall, if otherwise qualified, be eligible to receive a diplomatic visa if:
(1) The nonimmigrant alien is within one of the following categories, irrespective of the classification of the visa under § 41.12:
(i) Heads of states and their alternates;
(ii) Members of a reigning royal family;
(Goes on to list others so eligible.)

All heads of state automatically receive A1 classification and diplomatic status regardless of purpose of travel - they do not not have to be traveling on behalf of their government. All other visa applicants who are applying for an A-visa must be able to demonstrate a valid purpose of travel related to government work.

However, if I am reading the above correctly, as a member of the royal family, Harry doesn't need an A- visa to have the diplomatic classification. That said, I have seen commentary saying he will get the equivalent of head of state treatment (and A1 classification) because he is in the RF, although they don't explain how they make this leap of logic.

My own conclusion is that whatever Harry's visa classification is and whether he breached this, or whether he lied on his form about drugs, the diplomatic status he would have been afforded for (presumably) holding a diplomatic passport and being a member of the RF affording him a diplomatic visa, left him exempt from checks on his application by DHS in the first place, and immune from prosecution or other action against him now.

It’s beginning to get worrying for those of us on greencards here in the US - even with established US family you are not safe - Harry will be okay of course he will always have a soft place to land.

Well yes, once the Heritage Foundation undo the right to have your private information kept private then anyone could be vulnerable to having their information looked at and risk deportation - especially people who speak out against Trump and/or anything the Heritage Foundation doesn't like ( abortion rights, the right to access contraception being two). They don't care about Harry but they want political opponents gone. If they can get their private information disclosed and get them deported then it will be open season. But who cares eh? They are going after Harry, so let's cheer them all on!

Well, yes. Just as many people with less protection are facing victimisation.

I am not cheering any of them on. But I don't think Harry (or anyone else) should be able to buy preferential treatment.

Better genuine refugees get asylum in the USA (and UK) than someone with Harry's privilege

I doubt Harry will ever be deported, I also would be surprised if he lied on his visa application considering his drug use was well publicised., there is certainly another smoking gun which was already mentioned, but that will continue to be redacted.

I think the most that will happen is some disclosure he used Royal privileges or connection to attain / fast track his visa, and even if he did that, it will have been regularised in the interim the minute Heritage Foundation started asking questions.

Harry must be seething about it though.

I would love to know about that smoking gun, since the judge indicated that it related to something not already in the public domain; and something rather shameful.

Pointing out that H may experience the consequences of his own poor judgement is hardly cheering on the Heritage Foundation.

No one forced H to share his illegal drug use in print “Spare” and in various TV interviews. H’s foolish behavior created the remote possibility of him being deported as the US has the right to remove foreign nationals who violate its laws from its territory.

More likely, H will be protected by “Pa” but other less connected individuals will be harmed using the precedent created by H’s case.

Harry is the one who opened up that can of worms himself, he gave it to them on a silver platter, there is no hope of putting the genie back in the bottle.

No matter what side of the political divide you sit on, right wing, left wing or somewhere in the middle, most people resent the elite getting preferential treatment, which is why people want to see the outcome of this case.

From what I can tell ( I'm not a tax attorney and I don't work for the iRS) the problem seems to be that Archewell said they gave the money and it doesn't show up in the tax filings for the non-profit run by Biden's daughter. The fact that her father was president when they donated the money is noted. However, Archewell reported the gift and they are not responsible for the other non-profit's tax filings.

Harry is being used as a Trojan horse to get all sorts of protections removed from people who want to live in the US. You can bet that the people they go after won't be other privileged rich people but people who engage in protest against their project 25 agenda. Why are people so obsessed with the Heritage Foundation case and still speculating that they could get him deported if they aren't cheering them on? The Heritage Foundation wouldn't care less if Elon Musk had lied on his visa application about his prolific drug use.

The Heritage Foundation have a very disturbing - to put it mildly - agenda.

However, Harry has been very happy to benefit from the privileges that came with his position, while also complaining very loudly about the drawbacks.

I don't think anyone is 'cheering on' the Heritage Foundation. Just a little bit of amusement at Harry facing the reality of having 'escaped' the 'toxic' RF and finding that the grass isn't always greener.

You're going to have to take my word for this Tomato - but I don't want to see Harry deported. If he has an undue privilege , using a visa which it seems to me clearly not meant for his circumstances, then I would like to see him put on a more appropriate one, which still allows him to stay. But I think you are right , they are using him as a Trojan / stalking horse because he is hugely famous and will get attention. I have no desire to see a family split up (& I recognise others have or have been threatened with this ) but I would like to see a ludicrous privilege removed and something more appropriate put in its place. However I accept that my wishes and the HF are not aligned there. & that the circumstance is so exceptional it might be more effort than it is worth to change it.

Honestly , Tomatoater I don't hate H&M . I do think I am allowed to dislike things they have done and said and to have a giggle / discussion about some of their antics. But I am not gleefully awaiting a deportation (good job , I don't think this will happen in a month of Sundays - I think it will end up being a lot of sound and fury signifying nothing ) & I am certainly not gleefully awaiting a divorce. I'm sure Harry will be alright - but even with valid visa and court order against deportation can now get expelled in USA.

Original question about if he'd stayed would they still been fueding - I think it depends on how he'd been acting - more contact and perhaps he'd not as behaved as bad but as soon as half in half out was a no they were always going to be off.

I did notice one poster refer to Harry as second in line to the throne - he's never been that - William was second while the Queen lived - so highest Harry was was third and as soon as George was born he started dropping down. I think this is part of his problem - despite growing up in UK and part of the institution I think he came to understand his actual position very late.

They honestly didn't see anything wrong in basically asking to be excused all the tough, restrictive parts of being royal while retaining all the good bits: the glamorous events, the titles, the respect and kow-towing, the clothes allowance, security, palatial accommodation, super-luxury travel. Ha ha ha! They must have thought the Queen was an idiot.
