The patent office apparently has turned down the trademark of Meghans new jam making business American Riviera Orchard on the grounds that you can't trademark geographical locations. You would have thought somebody would have picked up on this before now.

Quite - they're putting a lot of time, effort and money into the media - they want the headlines, even from the Daily Mail.
On another thread pp discussed how they disseminate information to the tabloids, through their "Global Communications Team".

They could still copyright a logo but the actual name can be used by anyone. The irony is they only wanted to start a company to compete with Duchy Originals - not even directly but so they can say their products are better

I think you're right. There's no way someone who is apparently intelligent, detail oriented and has access to all the support and advice others could only dream of can make this many basic mistakes without at least some of them being deliberate to generate headlines.

I'm not buying that it was a mistake at all.

I just think that neither of them are quite as capable and competent as we've been lead to believe. They've both had sheltered, privileged lives. Sometimes it's tricky for people like that to manage themselves.

To be fair to Meghan - and I'm not a fan - applying for trademark or this sort of legal thing can be tricky. I applied for confirmation (like probate in Scotland) when my Dad died and that's more common than applying for a trademark and I had to get the solicitors involved as I wouldn't have managed the legal-ese by myself. If she's misjudged how much detail to put into an application, or the need to be very specific about exactly what sort of products are needed then it's a forgiveable mistake.

However, when you're so high-profile wouldn't you pay a branding expert or lawyer a couple of hours to talk you through the basics?

What is it with the terrible brand names? Archewell is bad and confusing, American Riviera Orchard is ridiculous. They sound like the work of a committee who all wanted different things and argued all night until they were so tired they agreed on a rubbish compromise. It’s not just about knowing the law, it’s about having the remotest feel for snappy branding. Just bizarre.

The trouble is they are self- styled experts at everything. They have the office and all the staff with grandiose sounding titles because that’s what other successful people (and crucially, the Royals) have. Not because they want help and advice. They clearly believe they have no need of that as they are already successful tv moguls, podcasters, cooks, authors, entrepreneurs and fashionistas. Oh… wait …

So I'm not feeling sympathetic.

I'm still seeing their mouthpiece magazines claiming that Highgrove produced its "rival" jam only after the launch of ARO.

If you google for pictures of the wedding, you can see Doria and Benita together in the background to Harry and Meghan in the foreground saying their vows. Doria was the lone family member from Meghan's side, but she wasn't "alone" in the chapel.

The thing is, even I know you can't copyright something like an area or a number. And I'm just a bog standard member of the public with no knowledge of patent law. Chanel once tried to sue a beauty parlour called Number 5 somewhere in the uk, based on the fact that apparently the public are so stupid they would think a nail bar was linked to Chanel. The address was number 5. So it failed but part of the whole defence was you can't copyright a word or name in ordinary parlance. If I know this then the most basic of lawyer should know this.

and definitely the whipsmart, super detail focussed Meghan should have known this 😂

And stole some of the Diana Awards thunder. At the time, those of us here saying the announcement of the ARO launch was timed specifically to steal William's speech-moment were assured by other posters here that it was just coinincidental. That ARO was months in the planning, and the announcement co-inciding with W's speech was just that - a coincidence.

Now it looks more that the announcement, at least, was deliberately, spitefully timed. If she ever did intend ARO to become a real business she is paying for the joy that moment gave her. All those companies recently invited to partner with her so she can promote their bags and earrings must be mightily unimpressed.
