I am concerned about the letter part of her case.
I agree that technically copyright should remain with MM.
However, if you were TM, and her friends had leaked information about the letter, that put you in an unfavourable light (as he perceived it), does he have the right, to use the same letter to defend himself.
Without the People article, no one would have known about the letter.

Kiwiz · 06/08/2020 16:12

I’m a bit confused as to how a judgment can be read in two different ways. It’s not ambiguous in any way, that’s precisely what judgments avoid being.

It’s also written in plain English, easy for lay people to understand. Judgments aim to do just that.

Meghan applied for an injunction to protect the names of the 5 friends. AN had already said they had no intention of publishing them. The judge agreed that they should be kept confidential for the time being. No doubt this will be impossible should the friends have to give evidence, hence it being an interim measure.

The judge also chastised both sides for leaking excerpts of court documents to the media.

What’s not to understand?

Why can’t we post DM and Cosmo links?

ButteryPuffin · 06/08/2020 16:13

That is an interesting conundrum, isn't it @milveycrohn? Very much so alongside Scobie's statement that Meghan had expected the letter to become public.

TheChristmasPrincess · 06/08/2020 16:13

Slightly off topic but does anyone else find Mr Justice Warby a bit dishy 😍😄

SunbathingDragon · 06/08/2020 16:18

I read somewhere (I think on one of these threads) that potentially under 50% of the letter was published which could work in the DM’s favour regarding the copyright claim. Does anyone else remember the discussion and know the exact details M’s legal team has to prove for copyright to be proven?

😂 😂 I'd say distinguished, rather than dishy. Definitely not my type.

Keanu Reeves now...

Roussette · 06/08/2020 16:20

Kiwiz your synopsis of the judgement is exactly as I understand it.

I've just google imaged The Judge. With his wig on, he has a distinct look of Mr. Bean to me!

Not my cuppa

I think you’re likely to be on your own with this! Grin
TheChristmasPrincess · 06/08/2020 16:51

😆 Fair enough

Will put him down on my weird crush list 😁🧐

OVienna · 06/08/2020 17:30

He doesn't do it for me either, at least in this photo.

I have attached a picture of my ultimate bad boy, Sexy John, who should be my nemesis given his overall tone on the US Supreme Court but he's been swinging Left recently.

I suspect he'll be too Yank for you all. Another time, another place I might have been a US housewife cooking his tea in a suburb of DC. I think I'm glad that didn't happen...!

Ovienna is that Justice Roberts?

OP posts:
OVienna · 06/08/2020 17:36

@Roussette yes, it is. Admit you fancy him.

OVienna · 06/08/2020 17:37

I'd even spell check his judgements for him! Wink

Can you imagine knowing before everyone else did what they'd contain?

I'd make him be nice to RBG tho.

SetPhasersTaeMalkie · 06/08/2020 17:38

Mike Pence is not too happy with Roberts at the moment so he must be doing something right.

Roussette · 06/08/2020 17:39

The more left he goes the more I might!

God bless RBG and keep her well.🙏

Oh yes. I hope she's OK. Last I heard she was poorly again, fingers crossed.

As a lawyer, I read the ‘someone called Omid Scobie’ as ‘This Twitter thing is not a part of my world; moreover, I am not familiar with professional gossips.’

AnneOfQueenSables · 06/08/2020 17:50

tbh I'm disappointed at the taste in judges exhibited on this thread Sad They make Judge Rinder look like a good prospect! I'm now Googling photos of judges to find a handsome one Grin

He’s been ruling on Twitter cases for a while.

I don’t mean that he isn’t aware professionally, it’s a signal that he sees himself above its grubby world. The rules on judicial conduct actually caution against judicial use of Twitter.

Seems incredibly sensible can imagine coming unstuck with drunken tweets.
